What to do when your Labuan account is frozen
A frozen account is stressful, but taking the steps in order makes it easier to handle. The freeze laws are federal, so they work the same in Labuan as anywhere in Malaysia.
What is different in Labuan is the court system, explained at the end. If you need the basics first, see understanding account freezes.
Step 1: Leave the money where it is
Do not move the remaining balance to a relative or to another account of your own.
After a freeze, moving money can look like an attempt to hide it, whatever your reason. Leaving the account alone protects you while you find out what happened.
Step 2: Find out who froze the account
An enforcement agency can freeze an account under AMLA section 44, and under section 50(1) the Public Prosecutor can order one. A police officer of Sergeant rank or above can also freeze an account under CPC section 116D, with no court order [f1][f4].
Ask your bank in writing for the freeze reference and the name of the authority. The answer decides your next step: a written request to an agency, or an application to court.
Step 3: Gather your papers
Collect the freeze notice, all letters, recent bank statements and a short written timeline. Add proof of your fixed monthly costs.
With a full set of papers, a lawyer can understand your case quickly. The same papers are your evidence if you ask for money to be released.
Step 4: Check Semak Mule
Check your account and phone number on the PDRM Semak Mule portal, which flags suspected mule accounts [f5]. If a scam caused the freeze, report it to the National Scam Response Centre on 997, which can act urgently [f6].
A flag means you may face a mule allegation as well as the freeze. If so, read mule account lawyer for Labuan.
Step 5: Ask for money for living costs
If an enforcement agency froze the account under AMLA section 44, section 44A lets you apply to release money for reasonable living or business costs [f3]. You apply in writing to that agency, and a more senior officer decides. No court is involved.
Approval is not automatic. Clear proof of real monthly costs makes the request stronger. Keep the AMLA time limits in mind throughout [f2].
Your account holder rights page explains what you can ask for. A lawyer can prepare the request for you.
Step 6: Find a lawyer who works in Labuan
Labuan is a federal territory, but it comes under the High Court in Sabah and Sarawak.
Ask whether the lawyer appears in the Labuan courts. Send us a short message and ask for a referral to an independent law firm that works in these courts.
Freeze paperwork in Labuan
Labuan has its own High Court, Sessions Court and Magistrate’s Court [f7]. If a police officer ordered the freeze, the notice may name the Labuan district headquarters, which the Sabah police directory lists [f8].
The Legal Aid Department lists a separate W.P Labuan office [f9]. A written release request under section 44A goes to the agency that froze the account, so you can start it from the island.
