What does accomplice mean?

An accomplice is someone who takes part with others in a crime. They may help, encourage or act together toward the same unlawful goal. The key idea is shared participation, not just being nearby when something happens.

In a mule account case, people fear being called an accomplice simply because their account was used. What decides it is knowledge and intention. Money passing through your account does not by itself make you an accomplice.

How can the label attach to you?

You do not have to be the main planner. Someone who knowingly helps a scheme can be pulled into the same case as the person who ran it.

That is why the section on the charge sheet matters.

Giving control of your own account to someone else is s424B: a fine of RM10,000 to RM100,000, or jail of 1 to 7 years, or both [f1]. Possessing or controlling another person’s account without lawful authority is s424A: a fine of RM5,000 to RM50,000, or jail of 6 months to 5 years, or both [f2].

Why does knowledge decide so much?

A person genuinely tricked into handing over access is in a very different position from someone who understood the plan. How you explain your role matters from the very first statement.

You have the right to consult and be defended by a lawyer of your choice [f3]. If you are worried about this label, a lawyer can help you set out what you knew and meant before anything is assumed against you.

Am I an accomplice if I only lent my account?

Not automatically. Lending or handing over your account can be charged as its own offence, but being called an accomplice depends on what you knew and meant. If you were tricked and knew nothing of the scheme, that goes to whether you shared any criminal intention.

Does an accomplice get the same punishment?

Someone who knowingly takes part in a crime can be treated much like the main offender. The section charged and your actual role both matter. Two people in one case can face very different outcomes, depending on knowledge, intention and evidence.

How do I show I did not knowingly take part?

Your own account of events, your messages and the timeline all help show you shared no criminal intention. A lawyer can organise this material and present it to investigators or the court. Your right to be defended starts from the first day.
