What does acquittal mean?

An acquittal is a court’s decision that a charge has not been proven, so the accused is cleared of that offence. It is the opposite of a conviction. It means the prosecution did not prove guilt beyond reasonable doubt.

An acquittal is a finding on the evidence, not a favour. On what was put before the court, the case did not stand. Each mule account case turns on its own facts. Police detected 46,048 mule accounts in 2023 and 50,295 in 2024 [f2].

When can a court acquit?

An acquittal can come at two stages. At the end of the prosecution’s case, the court may find there is no case to answer and acquit without calling the defence. Or, after hearing the defence, the court may find a reasonable doubt and acquit at the end of the trial.

Either way, the charge fails. This is why preparation matters, from the documents you gather to the questions asked of witnesses.

What does an acquittal settle, and what not?

An acquittal clears the criminal charge. It does not automatically release a frozen account, which is handled under separate laws. The two can run side by side, and you may still need to act on the freeze.

The prosecution may also appeal an acquittal within set time limits. You have the right to be defended by a lawyer of your choice [f1]. If cost worries you, the Legal Aid Department (Jabatan Bantuan Guaman) helps people who qualify [f3].

How can an acquittal happen?

The court can acquit at the end of the prosecution's case if it finds there is no case to answer. It can also acquit at the end of the trial if the defence raises a reasonable doubt. Either way the charge is not proven, so you are cleared of that offence.

Is an acquittal the same as an unfreeze?

No. An acquittal deals with the criminal charge. A frozen account is a separate matter under different laws and processes, so it is not released automatically. You may need to take further steps on the freeze itself, and a lawyer can explain how the two fit together.

Can the prosecution appeal an acquittal?

In some cases the prosecution may appeal against an acquittal within the time limits set by law. So an acquittal is not always the final end of the matter. A lawyer can tell you whether an appeal is likely in your case.
