What it means
Bail is a release from custody while the case continues. The accused stays free on conditions, a bail sum and a surety, instead of waiting in custody.
Bail does not say you are innocent or guilty. It only decides whether you can be free, and on what terms, until the case ends.
Is bail a right for mule-account offences?
Yes. The three mule-account offences in the Penal Code are bailable, so bail is a right. The court (or police) still sets the amount and the conditions, and no one can promise what those will be.
Seriousness affects the terms. Section 424A carries a fine of RM5,000 to RM50,000 or 6 months to 5 years jail, or both [f1]. Section 424C carries 3 to 10 years jail or a fine of RM10,000 to RM150,000, or both [f2].
The court also weighs whether you will attend later hearings.
Conditions and sureties
Bail comes with conditions, such as a bail sum, a surety or regular reporting. A surety is someone who pledges to make sure you attend court.
Think early about who could be your surety and collect their documents, so the hearing goes smoothly. A lawyer can propose realistic conditions instead of leaving them to the other side.
How to prepare
Read about the bail process, gather proof of your ties, such as an address, job and family, and keep your records in order.
You have the right to consult and be defended by a lawyer you choose [f3]. If you or someone close to you needs bail, a lawyer can present your position to the court honestly and clearly.

Is bail guaranteed?
The mule-account offences (Penal Code s424A, s424B, s424C) are bailable, so bail is a right. But the court or police set the amount and conditions, and no one can promise what they will be. Be careful of anyone who does. Gather proof of your ties and let a lawyer present your position.
What affects the bail amount and conditions?
The court looks at how serious the alleged offence is and whether you will attend future hearings. A fixed address, steady work and family responsibilities help. A clean record and cooperation also count. A lawyer can explain how these apply to you.
What is a surety in bail?
A surety is a person who takes responsibility for making sure the accused attends court, by pledging a bail sum. The court may require one as a condition of release. Decide early who could act as surety and gather their documents, so your lawyer can move fast at the bail hearing.
