What is a frozen account?

A frozen account is a bank account you can no longer withdraw from, transfer out of or use for payments. The balance stays where it is while an authority investigates whether the money is linked to a crime. A freeze is an investigative step, not a conviction.

People find out when a card is declined or a transfer fails. The freeze can cover the whole account or only part of the balance. It does not mean you have been charged, but it does mean an investigator has noticed your account.

Who can freeze an account?

Two powers are used most in Malaysia. Under AMLA section 50, the Public Prosecutor can order a bank not to let suspected proceeds of unlawful activity be dealt with. [f1]

Under the 2024 amendments, a police officer of Sergeant rank or above can also freeze an account straight away, without a court order, under section 116D of the Criminal Procedure Code. [f3]

A freeze can be linked to a mule account investigation, where scam money has passed through the account. The National Scam Response Centre hotline 997, which runs 24 hours, can also trigger urgent freezes when a scam is reported quickly. [f4]

How long does a freeze last?

An AMLA seizure or Public Prosecutor order lapses if you are not charged within 18 months. [f2] An enforcement agency’s freeze under section 44 ends after 90 days if you are not charged. A police freeze under section 116D lapses 18 months after the order if nobody is prosecuted over the money.

You are not powerless. A freeze is not a charge, and a later charge, such as one under section 424A, is a separate step. Get advice before you give the police a statement, and a lawyer can help you ask for money for living costs.

What does a frozen account mean?

A frozen account is one you can no longer withdraw from, transfer out of or use for payments. The money stays in place while an authority investigates whether it is linked to a crime. A freeze is an investigative step, not a conviction, and it does not mean you have been charged.

How long can a bank account stay frozen in Malaysia?

It depends on the power used. A section 44 freeze ends after 90 days if you are not charged. An AMLA seizure or Public Prosecutor order lapses if you are not charged within 18 months. A police freeze under section 116D lapses after 18 months if nobody is prosecuted over the money. A lawyer can check which one you have.

Can I get money out of a frozen account for living costs?

Possibly. For a section 44 freeze, you can apply in writing to the agency that issued it to vary the order, for example for reasonable living or business expenses. A more senior officer decides, and the answer can be no. For a section 116D police freeze, you apply to the Sessions Court. A lawyer can prepare the application.
