Which court in Kedah will hear a frozen-account case?

If your account is frozen and you live or bank in Kedah, your case goes through the Kedah courts. The High Court for the state is in Alor Setar.

The prosecution decides whether a charge is heard in the Magistrates’ Court or the Sessions Court. A lawyer can tell you which court applies once any charge is made.

How do the freeze and mule-account laws apply in Kedah?

The freeze powers are federal, so they are the same in Kedah as anywhere else. Under AMLA 2001, the Public Prosecutor can freeze an account suspected of holding money from crime [f1]. That order lapses if the person is not charged within 18 months [f2].

Under the 2024 amendments, a police officer of Sergeant rank or above can also freeze an account without a court order [f3].

Separately, Penal Code sections 424A to 424C make three things offences [f4]. Section 424A covers holding or controlling someone else’s account, and section 424B covers handing control of your own account to someone else. Section 424C covers transactions through an account without a lawful purpose.

Who investigates a mule-account report in Kedah?

In Kedah, police work runs through the state police contingent (IPK) in Alor Setar and district police headquarters (IPD) such as Kota Setar, Kuala Muda, Kulim and Langkawi [f6].

The Commercial Crime Investigation Department (JSJK or CCID) is a national department at Bukit Aman. Knowing which IPD opened your file helps a lawyer find it and see how far it has gone. For the wider picture, read our guide on understanding account freezes.

Who can represent me in Kedah?

Because the law is federal, any lawyer admitted to the Malaysian Bar can act for you, wherever in Kedah the case is. A lawyer who can attend court in Alor Setar just saves travel.

Choose a lawyer for their experience with freeze and mule-account cases, not their office address. Our page on finding legal help explains what to look for.

There are two options if cost is a worry. The Legal Aid Department (Jabatan Bantuan Guaman) office in Kedah helps people who meet its income limits. The Bar Council Legal Aid Centre (Kedah) runs under the Malaysian Bar.

Neighbouring Perlis is under the same federal law, so the same options apply if your case crosses the state line.

What should I do on the first day?

Start with the facts. Enter your account or phone number on the PDRM Semak Mule portal to see if it is flagged [f5]. Keep every bank letter, SMS and screenshot together.

Do not move money or open new accounts to get around the freeze. If you cannot tell which power froze your account, ask a lawyer to find out. They can then say whether you can apply to release money for daily costs.

The Kedah High Courts are at Alor Star and Sungai Petani [f7]. The Legal Aid Department (JBG) lists offices in Kedah and Langkawi [f8].

The Kedah Bar Committee is part of the Malaysian Bar, and the Bar Council Legal Aid Centre for the state is in Alor Setar [f9].

You may be asked to give a statement at a police station, possibly the IPD covering your area. Your first court mention is at the court named in the charge sheet or summons. A WhatsApp enquiry needs no travel.

Is the High Court in Alor Setar or Sungai Petani?

Kedah has two High Court locations, Alor Star and Sungai Petani, each in its own Kompleks Mahkamah [f7]. Read the notice, summons or charge sheet for the court named. The prosecution decides whether a charge starts in the Magistrates' Court or the Sessions Court.

Which police office handles a Kedah report?

Kedah has one state police contingent (IPK) in Alor Setar and eleven district headquarters (IPD), from Kota Setar to Langkawi [f6]. Your call or letter may name the officer and station. If it does not, a lawyer can ask which IPD holds the file.

How long can a Kedah account stay frozen?

An AMLA freeze ordered by the Public Prosecutor lapses if the person is not charged within 18 months [f2]. Under the 2024 law, police can also freeze an account quickly without a court order [f3]. Because there are two different powers, ask a lawyer to find out which one was used on your account.

Do I need a lawyer based in Kedah?

Not necessarily. Any lawyer admitted to the Malaysian Bar can act for you, wherever the case is. One who can attend court in Alor Setar is more convenient, but choose by experience with freeze and mule-account cases, not by address. Legal aid is available if cost is a worry.

Can I check if my account is flagged as a mule?

Yes. On the PDRM Semak Mule portal, you can enter an account or phone number to see if it has been reported [f5]. A flag explains why a bank blocked transactions, but it does not prove you did anything wrong. Note what you find and speak to a lawyer before contacting anyone about it.
