Gave Your ATM Card to a Loan Shark?
You handed over your card under pressure, and now your account is frozen and under investigation.

How do loan sharks use your ATM card?
Here is how it can go. You borrow from a loan shark, and they demand your ATM card and PIN as security. [f2] You agree because you need the money and expect the card back once you repay.
What follows is out of your hands. The loan shark passes your card to a syndicate, which uses your account to receive and move scam money. Your account becomes a mule account without you doing anything more.
When police trace the stolen money, they find your account. [f3] It is frozen, and you are now part of a criminal investigation. The loan shark may have disappeared, leaving you to face it.
Which offence could you face?
The Penal Code’s mule account offences include Section 424B, which makes it a crime to give control of your own payment instrument to someone else without lawful authority or lawful purpose. [f1] That covers ATM cards, debit cards and online banking logins.
Handing over your own card is Section 424B, the law against giving someone else control of your account. It carries a fine of RM10,000 to RM100,000, or 1 to 7 years in prison, or both. [f1]
These offences were added in 2024. What you knew and why you handed over the card matter to your defence.
A lawyer who handles mule account cases can tell you whether your facts support a defence.
Why does pressure from the loan shark matter?
Giving your card to a loan shark is not the same as selling it or lending it to a friend. Loan sharks work through fear. They know you are in money trouble and use that to take your bank cards. [f4]
The court can look at the money pressure you were under and any threats from the loan shark. It can also weigh your belief that the card was only security, and whether anything warned you of crime.
Your lawyer can show the loan deal, the pressure used and the fact that you made none of the transactions. That can show someone who was used, not someone who took part.
What should you do right now?
If your account was frozen after you gave your ATM card to a loan shark, take these steps now.
Do not contact the loan shark. More contact makes your position harder. Do not pay them, reply to threats or try to get the card back yourself.
Gather your evidence. Keep every record of the loan: messages, receipts and transfers. If anyone else knew about the loan, note their details.
Speak to a lawyer before giving a police statement. If police call you in, attend, but ask to consult a lawyer before answering questions, because your first statement shapes the investigation.
Check your account status. Confirm the freeze with your bank, note the date you found out, and ask which authority ordered it.
Get legal advice now. A lawyer who handles mule account cases can review your case, tell you how strong your defence is and represent you if police call you in.
What will your lawyer focus on?
The loan deal. Your lawyer will set out how you came to borrow, the terms and how the card was demanded. This shows the money pressure and that you did not hand over the card for crime.
What you knew at the time. Under the mule account offences, including Section 424B, what you knew and why you handed over the card matter. If you believed the card was only security for the loan, your lawyer will gather evidence of that.
Your cooperation. Helping the investigation through the right channels, naming the loan shark and showing the loan records all help you. Your lawyer will guide this so it protects you while helping police find the real offenders.
The wider pattern. Loan shark syndicates using borrowers is a known pattern. Your lawyer can raise it in your mule account defence to show the court you were a victim of the syndicate, not a partner.

Can I be charged for giving my ATM card to a loan shark?
Yes. Giving someone else control of your own card or account is an offence under Section 424B of the Penal Code, with a fine of RM10,000 to RM100,000, or 1 to 7 years in prison, or both. How and why you handed over the card still matters to your defence.
Is financial pressure a valid defence?
A court can take threats and money pressure into account. If the loan shark made your card a condition of the loan, your lawyer can use that to show you did not willingly join in any crime. Records of the pressure you faced make this stronger.
What if I did not know they would use my account for scams?
What you knew matters to your defence. If you truly believed the card was held only as security for the loan, that is a key point. Your lawyer will look at your exact facts to build it.
Should I report the loan shark to police?
Reporting the loan shark shows you are cooperating and supports your position as a victim. Do it with a lawyer's help. Your statement goes on the record, and a lawyer can help you explain things without harming your own defence.
My account is frozen. How do I access money for daily expenses?
You can ask for part of the money to be released for rent, food and bills. For an AMLA s44 freeze, you apply in writing to the agency that issued it, and a more senior officer decides. For a police freeze under CPC s116D, you apply to the Sessions Court. A lawyer can prepare this with your monthly costs.
Will the money in the frozen account be returned to me?
If the investigation shows you were not part of the crime, you can ask for the money to be released when the freeze ends. A freeze holds your money; it does not take it away. A lawyer can ask for the freeze to be lifted.
Can the loan shark be charged instead of me?
The loan shark can face charges under several laws, including the Moneylenders Act and the Penal Code. Police look at everyone involved. Helping them identify the loan shark supports your position as a victim.
