Your Ipoh account has been flagged as a mule account
You have just learned your account is being investigated as a mule account in Ipoh. The hardest part can be not knowing how serious it is.
A mule case is not one offence. It is a group of related sections with very different penalties, so finding out which one fits you comes first.
Three sections, three very different penalties
These offences are federal and come down to three sections. Section 424A covers possessing or controlling someone else’s account [f1]. Section 424B covers giving control of your own account to someone else [f2].
Section 424C is the heaviest. It covers transactions through an account without a lawful purpose, with 3 to 10 years in jail or a fine of up to RM150,000 [f3]. The gap between the lightest and heaviest section is large, so the facts of your case matter.
Which Perak court and police unit handle the case
The High Court for Perak sits in Ipoh. Mule offences are tried in the Magistrates’ Court or Sessions Court, and the prosecution decides which.
The Commercial Crime Investigation Department investigates mule cases [f4]. The Perak police contingent (IPK) and the Ipoh district police HQ (IPD) are the local offices. How these officers read the facts shapes which section they pursue.
How a lawyer works out what you are really facing
The key question is your actual role. Did you only let someone use your account, or did you move the money yourself? The answer can decide between a lighter section and the heaviest one.
A lawyer helps you gather records that show your role and explains your position clearly. Under Article 5(3) of the Federal Constitution, an arrested person has the right to a lawyer of their choice [f5], and you can seek a lawyer’s advice before any police interview. The section 424C explainer covers the heaviest charge in detail.
Where a mule case sits, and help with cost
Ipoh is one of the places where a High Court sits. [f6] Which court hears a charge is decided by the prosecution, not by where you live.
If cost is a worry, the Malaysian Bar runs its Perak Legal Aid Centre in Ipoh. [f8] The Legal Aid Department has a Perak office and a Taiping office. [f7]

What to send first
You do not need to work out the section yourself. A short message on what happened with your account in Ipoh, and when, is enough for a lawyer to start.

How do I know which section I am being investigated under?
At first you may not. Section 424A is about possessing or controlling someone else's account, 424B about giving control of your own account to someone else, and 424C about transactions through an account without a lawful purpose. Your facts decide which applies, and a lawyer can help you find out early.
Why is section 424C treated as the most serious?
It is about the money actually moving through an account without a lawful purpose, not only who held it. The penalty is 3 to 10 years in jail or a fine of RM10,000 to RM150,000, or both. If you never made those transactions, it may not fit your case.
Does an Ipoh case follow different rules?
No. The sections are federal and the same nationwide. Ipoh matters only for venue: the High Court sits in the city, and a charge goes to whichever court the prosecution chooses.
Should I speak to the police before I understand the sections?
Get advice first if you can. Under Article 5(3) of the Federal Constitution an arrested person has the right to consult a lawyer of their choice. Knowing which section is in play helps you answer accurately instead of guessing.
Can a lawyer change which section I am charged under?
A lawyer cannot decide the charge. But the evidence, and how your role is explained, can shape how the case is seen. Showing that you never made the transactions yourself matters when the sections differ this much.
