Restricted and frozen are not the same

When your account stops working normally, first find out whether it is restricted or frozen. They have different causes and different fixes, and using the wrong process wastes time.

A restricted account has limits put on by the bank itself. [f1] A frozen account has every transaction blocked by a legal authority. [f2] The difference decides who you need to contact and what will get the block lifted.

What is a restricted account?

A restriction is the bank’s own step. Its compliance team limits some functions because its systems flagged activity that needs checking. [f1] The bank does this under its account terms and its duties under the Anti-Money Laundering Act 2001.

Common restrictions block outgoing transfers, limit ATM withdrawals or suspend online banking. Some are partial, so other functions still work. For example, your salary may still come in while you cannot make transfers.

A restriction is not a criminal process. The bank wants papers that explain the flagged transactions, and lifts the restriction once it is satisfied. Our bank compliance hold guide gives the steps in detail.

What is a frozen account?

A frozen account is blocked by an outside legal authority. [f2] Examples are a police freeze under CPC section 116D, an enforcement agency freeze under AMLA section 44 and a Public Prosecutor order under AMLA section 50. A court garnishee order, which lets a creditor take money owed from your account, can also freeze funds.

When an account is frozen, nothing goes in or out. The bank did not choose this. It is following a legal order from the police, the Public Prosecutor or a court.

To lift a freeze, you have to deal with the authority that ordered it. [f4] The bank cannot lift it on its own. Your lawyer handles this through written representations, applications to vary the order, or court action.

How to tell which one you have

Start with your bank. Call customer service and ask two questions: who put the block on, and what is the reference number? [f5]

If the bank says it is an internal compliance check, you have a restriction. If it gives a police report number, an AMLA order or a court case number, you have a freeze.

Check any letters, emails or SMS you received. A restriction may come with a request for documents. A police freeze may mention a report number. An AMLA freeze mentions the Public Prosecutor’s office.

How to get a bank restriction lifted

A restriction can be cleared by giving the bank the documents it needs to settle its concerns. [f3]

Reply to the bank’s requests quickly. It may ask for proof of income, papers showing where the money in certain transactions came from, and a written explanation of the flagged activity. The bank will tell you exactly what it needs.

A restriction can be lifted once the bank is satisfied with the documents, but no time is fixed. [f3] If you hear nothing, follow up with the compliance team and ask whether they need anything else. Our guide on bank compliance holds covers this in detail.

A legal freeze needs a different approach. The bank cannot help directly, because it is following an outside order. [f4]

  • Police freeze: your lawyer writes to the Investigating Officer, shows where the money came from, and asks for the freeze to be lifted. If that does not work, your lawyer can apply to the Sessions Court to vary or revoke the order.
  • AMLA freeze: if an enforcement agency froze the account under section 44, your lawyer can apply in writing to that agency under section 44A to release money for basic living costs. Our freeze types comparison guide explains the process for each type.
  • Court garnishee order: your lawyer files an objection with the court that made the order. This is a civil process with strict deadlines.

When a restriction becomes a freeze

A restriction can turn into a legal freeze. If the bank finds activity it cannot clear with documents, it may file a suspicious transaction report (STR) under AMLA section 14.

That report goes to Bank Negara Malaysia’s financial intelligence unit, which may pass it to the police. What began as a bank restriction can then become a formal police or AMLA freeze.

The best way to stop this is to answer the bank’s requests quickly and fully. Ignoring them makes it more likely a banking issue becomes a legal one.

Partial restriction or full freeze?

Some blocks fall in between. A partial restriction may stop transfers out but still let your salary in. A full freeze blocks everything.

Knowing exactly what is blocked helps your lawyer choose the best approach. If money can still come in, the pressure is different from a full block that stops your salary.

Ask your bank which functions still work and which are blocked. Your lawyer needs this to prepare the right letters or applications.

What to do right now

First, call your bank and confirm whether it is a restriction or a freeze. [f5] Write down who put it on, the reference number and what is blocked.

For a restriction, gather the documents the bank asked for and send them as soon as you can. Replying quickly helps.

For a freeze, contact a lawyer who handles frozen account cases. Bring the bank’s confirmation, any letters or SMS, and recent bank statements. The lawyer can then check who froze the account and start the process to lift it.

Common mistakes to avoid

Do not assume a restriction is a freeze. Paying a lawyer to file legal applications for what turns out to be a bank check wastes money. Confirm the type first.

Do not ignore a restriction and hope it goes away. Nothing says a restriction will lift by itself. If you do not reply, the bank may file a suspicious transaction report.

Do not try to move money to other accounts while any block is in place. Whether it is a restriction or a freeze, trying to get around it can cause new problems and look bad to investigators or the bank.

How do I know if my account is restricted or frozen?

Call your bank and ask whether the block was put on by the bank itself or ordered by an outside authority. The bank may be able to tell you. A restriction comes from the bank; a freeze comes from the police, the Public Prosecutor or a court.

Can I still receive money into a restricted account?

It depends on the restriction. Some block money going out but still let money come in. Others block everything. Your bank's compliance team can tell you exactly what is blocked.

Is a restricted account a sign of police investigation?

Not necessarily. A restriction can be set off by the bank's own systems spotting unusual transactions. That is an internal bank check, not police action. But it can become more serious if the bank files a suspicious transaction report.

How long does it take to unfreeze a frozen account?

A legal freeze stays until it is lifted, varied or lapses. An AMLA section 44 freeze lasts up to 90 days unless you are charged. A police freeze under CPC 116D, and an AMLA section 50 order, lapse after 18 months without a charge or prosecution. Your lawyer can ask the authority to lift or vary it earlier.

Do I need a lawyer for a restricted account?

Not always. A restriction can be lifted by giving the bank the documents it asks for. But if it drags on, or the bank mentions filing a report, it is worth speaking to a lawyer.

Can a restriction become a freeze?

Yes. If the bank's review finds activity that calls for a suspicious transaction report under AMLA section 14, the matter may go to Bank Negara or the police. The restriction could then become a formal legal freeze.
