The Cost of Waiting on a Frozen Account
Some steps in a frozen-account case get harder with time: know which ones to take first.

Why waiting feels like the safe choice
When your account is frozen, doing nothing can feel careful. You have not been charged, nobody has explained much, and reacting might seem to make things worse.
But waiting is not neutral. Several clocks start running, and some of them run against you. Time can also work for you in places.
Your evidence fades
Your strongest tool is a clear record of what happened: who contacted you, what they said, which messages you swapped, and when the account was opened.
That record can fade. Chats get deleted, phone numbers stop working, and dates and names are easy to forget.
Save it early. Our guide to evidence preparation shows what to keep.
The investigation keeps moving
While your evidence fades, the investigation moves on. The police can pull bank records and trace the money, whether you take part or not.
Under CPC section 116D, a police officer of Sergeant rank or above can now freeze an account at once, without a court order. [f4] So the freeze can come before you know why, and the investigation carries on behind it.
Waiting does not pause any of this. It only means you face the case later, with less ready.
The 18-month limit is not a rescue
You may hold on to the idea that a freeze cannot last forever. That is partly true. Under section 52A of the Anti-Money Laundering Act (AMLA), a seizure order lapses 18 months after it is made if you are not charged and no prosecution starts. [f1]
But it is an outer limit, not a promise that your money comes back. If you are charged inside that time, the money can stay held and other orders can follow.
The limit helps most when you use the months to prepare. Our freeze duration guide explains how these limits work.
Scam money moves in days
If you were tricked into moving money, the chance to trace it may be counted in days, not months. Once it passes through several accounts, getting it back can be harder.
The National Scam Response Centre hotline 997 can trigger urgent freezes further down the chain so the money can be traced. [f2] It works best if you call early.
Your bills do not wait
Rent, loans and daily costs keep coming while the freeze holds. They can pile up while you hope the freeze will lift soon.
You do not have to sit and wait. Under AMLA section 44A you can make a written application to the agency that froze the account, asking it to release money for reasonable living or business costs. [f3]
The application needs proof of your costs. The sooner you send it, the smaller the debt you build up.
What to do first
These clocks reward acting early.
Save your evidence now. Call 997 if money was moved out. Apply in writing to the agency that froze the account, under section 44A, if bills are piling up.
You have the right to a lawyer of your choice from the very start. [f5] A lawyer can check which time limits apply to your freeze and prepare the section 44A application for you.
For the first steps, read first hour actions and what to do now.

If the freeze lapses after 18 months anyway, why not just wait?
The 18-month limit on a seizure order under AMLA section 52A is an outer limit, not a promise your money comes back. If you are charged before it ends, the freeze can stay or other orders can follow. Waiting also lets your evidence go cold. The limit helps most if you used the time to prepare. [f1]
Does acting fast help recover money that left my account?
It can, but only for a short time. The NSRC hotline 997 can trigger urgent freezes further down the chain so the money can be traced before it spreads. Delay gives it more time to move on. If you were tricked into moving money, report it as early as you can. [f2]
Can I get some of my own money released while I wait?
Possibly. Under AMLA section 44A you can make a written application to the agency that froze the account, asking it to release money for reasonable living or business costs. A more senior officer decides, and it is not automatic. Applying early can help stop your bills piling up. [f3]
The police froze my account straight away. Is there still time to respond?
Yes, but less than before. Under CPC section 116D a police officer of Sergeant rank or above can freeze an account at once, without a court order, so the freeze can arrive before you know why. That makes early advice more useful, not less. You have the right to a lawyer of your choice from the start. [f5]
