A frozen account far from home

For a foreigner in Malaysia, a frozen bank account is hard. Your salary, rent and daily spending may all go through that one account.

The law does not treat you differently because of your nationality. Knowing how the freeze works, and what you can apply for, helps you act calmly.

Freezes apply to accounts, not passports

The power to freeze depends on the account and the suspicion about it, not on citizenship. Under CPC section 116D, a police officer of Sergeant rank or above can freeze an account straight away, without a court order, if they suspect a link to unlawful activity [f1].

Separately, under AMLA section 50(1), the Public Prosecutor can order a bank not to release money suspected to come from unlawful activity [f2]. The same rules apply to locals and foreigners.

Your right to a lawyer

Being a foreigner does not take away your basic protections. Article 5(3) of the Federal Constitution gives you the right to consult and be defended by a lawyer of your choice [f5].

That right does not depend on citizenship. Use it early, before you give a detailed statement to the police.

Getting money released for living costs

An urgent problem can be paying for daily life. How you ask depends on which law froze the account.

If it was frozen under AMLA section 44, you can apply in writing to the agency that froze it. Under section 44A, a more senior officer can vary the freeze to release money for reasonable living expenses [f4]. No court is involved.

If the police froze it under CPC section 116D, you apply to the Sessions Court instead. A lawyer can tell you which route applies and prepare the application with proof of your rent, bills and daily costs.

How long a freeze can last

A section 44 freeze ends after 90 days if you are not charged. A seizure order lapses 18 months after it is made if you are not charged and no prosecution starts [f3].

That is the outer limit, not a forecast for your case. Keep the freeze notice and any reference numbers, and get advice instead of waiting it out.

When the letters are not in your language

Language does not take away your rights, but it can make things hard to follow. Keep every document you receive, and ask the bank or police to put requests in writing.

If a notice is unclear, get help reading it before you reply. You can have a lawyer of your choice explain each document to you [f5].

Do not sign or answer anything you only half understand. Ask for plain explanations until it makes sense.

What to do now

Gather your records:

  • the freeze notice or any letter from the bank or police;
  • your bank statements;
  • your passport and work pass;
  • proof of regular costs such as rent, utilities and school fees.

Write a simple timeline of what happened and when. Then get advice on the freeze and on releasing money for living costs at the same time [f4].

Getting help as a foreigner

Dealing with this in another country can feel lonely. But the law here gives you rights and routes to use.

A lawyer can explain the freeze in plain words and apply for the money you need to live. Send us your details by WhatsApp and we can refer you to a lawyer.

Does being a foreigner change how a freeze works?

No. Freeze powers apply to the account, not your nationality. Police can freeze an account under CPC section 116D [f1], and the Public Prosecutor can order a bank not to release money under AMLA section 50(1) [f2]. Your right to a lawyer of your choice is the same as a citizen's [f5].

I cannot pay rent while my account is frozen. What can I do?

If the freeze is under AMLA section 44, you can apply in writing to the agency that froze it to release money for reasonable living expenses under section 44A [f4]. A police freeze under CPC section 116D is varied by applying to the Sessions Court instead. A lawyer can prepare either application with proof of your rent and daily costs.

How long can the freeze last?

A section 44 freeze ends after 90 days if you are not charged. A seizure order lapses 18 months after it is made if you are not charged and no prosecution starts [f3]. That is the outer limit, not a forecast for your case. Keep the freeze notice and reference numbers, and get advice rather than just waiting.

I do not speak Malay well. Does that matter?

It does not reduce your rights, but it makes clear advice more important. You can be defended by a lawyer of your choice [f5]. Ask for documents in writing and get help reading every notice before you reply, so you do not miss a deadline.
