Why a freeze hits so hard

When an account is frozen, the first shock can be practical. Bills still come, the family still needs food, and the money is suddenly out of reach.

Under AMLA s50(1), the Public Prosecutor can order a bank to freeze accounts suspected to hold proceeds of unlawful activity [f3]. Suspicion is enough to lock the money; it is not a finding of guilt.

So there are two problems: the money and the legal case.

Asking for money for living expenses

The law accepts that people still need to live. If the freeze is under AMLA s44, you can apply in writing to the agency that froze it. Under AMLA s44A, the agency can vary the freeze to release money for reasonable living expenses [f1].

You have to apply; it does not happen on its own. A vague request is weaker than a clear list of rent, food, utilities and other essential costs, backed by bills.

A lawyer can work out which law froze your account, because the route is different for each, and prepare the application with the right figures and proof.

Budgeting for a set period

The freeze is not open-ended. A section 44 freeze ends after 90 days if you are not charged. Under AMLA s52A, a seizure order lapses 18 months after it is made if you are not charged and no prosecution starts [f2].

That gives you an outer limit to plan around, even if your case ends sooner.

Then:

  • list your essential monthly costs;
  • cut what you can;
  • note any lawful income or support outside the frozen account.

A clear picture of what you have and what you need guides every other decision.

Dealing with bills and lenders

Ignoring bills and loan repayments makes things worse. It is better to tell lenders early than to let payments just stop.

Contact them, explain that your account is frozen, and ask about a temporary arrangement or deferral. Write down who you spoke to and what was agreed.

If you have a complaint about how a bank has treated you, Bank Negara Malaysia runs BNMLINK on 1-300-88-5465 for complaints and enquiries [f4].

Avoid creating a new problem

Some people under pressure make choices that add legal risk. Never use someone else’s account, and never let anyone pass money through an account in your name. That is exactly how mule cases begin.

If you are already under investigation, moving money in a way that looks like dodging the freeze can be badly misread. Speak to a lawyer before you open new accounts or move funds.

Staying steady

Keep statements, bills and every letter about the freeze in one place. Organised papers make any application faster and stronger.

Make a short weekly plan of what must be paid and what can wait. Ask trusted family for help with essentials while the case runs.

A lawyer can handle the application for living expenses and advise you on what to pay first. Send us your situation by WhatsApp and we can refer you to one.

Can I get any money out of a frozen account?

You can ask. If the freeze is under AMLA s44, you can apply in writing to the agency that froze it to release money for reasonable living expenses under s44A. No court is involved. A clear list of your monthly needs, with bills attached, makes the application stronger.

How long could the freeze last?

A section 44 freeze ends after 90 days if you are not charged. Under AMLA s52A, a seizure order lapses 18 months after it is made if you are not charged and no prosecution starts. That is the outer limit to plan around. Your case may be resolved sooner.

What should I do about bills and loan repayments?

Do not ignore them. Contact the bank or lender early, explain that your account is frozen, and ask about a temporary arrangement. Keep a written note of who you spoke to and what was agreed.

Should I open a new account or use someone else's to keep receiving money?

Never use someone else's account, and never let anyone route money through an account in your name. That is how mule cases start. If you are under investigation, even a new account of your own can look like dodging the freeze, so speak to a lawyer first.
