What Decides How Long a Freeze Lasts
How long a freeze lasts depends on which legal power was used and whether you are charged.

Most people want one answer to “how long will my account stay frozen?”. There is no single number. Anyone who gives you one confident figure is guessing.
How long a freeze lasts depends on a few factors. Once you know them, you can see why your case may run differently from a friend’s.
Factor one: which legal power was used
This matters most. Under AMLA section 50, the order comes from the Public Prosecutor, and the law sets a time limit on it [f1] [f2]. A freeze by an enforcement agency under AMLA section 44 lasts up to 90 days unless you are charged. A police freeze under Criminal Procedure Code section 116D can be made on the spot, by an officer of Sergeant rank or above, without a court order [f4].
Look at your freeze notice and find the section it names. Two freezes on the same facts can last very different lengths of time, depending on which power was used.
Factor two: the AMLA 18-month limit
Where AMLA applies, section 52A sets an outer limit. The order lapses automatically if you are not charged within 18 months [f2].
The Court of Appeal looked at this limit in Lim Hui Jin v CIMB Bank Bhd & Ors [2018] [f5]. The limit means the freeze cannot run forever under that power, but it does not promise an early release.
For a police freeze under section 116D, there is a separate rule. It lapses 18 months after the order if no prosecution is started over the money.
Factor three: whether you are charged
If no charge is brought within the AMLA period, the freeze lapses [f2]. If you are charged, the money question can move into the court case.
So the same freeze can end quietly at the limit, or turn into a longer court matter. Counting down to month 18 can mislead you, because that date only matters if no charge comes first.
Factor four: how fast the investigation moves
Within these limits, the real pace depends on the investigation. How complex it is, how many accounts are involved, and how quickly the key facts become clear all matter.
You cannot control this pace, but you can avoid slowing it. A tidy timeline and clear answers help. Moving money around or giving answers that contradict each other can raise more questions.
Releasing living expenses does not end the freeze
Section 44A lets you ask for money to be released for reasonable living and business costs while the freeze stays in place [f3]. You apply in writing to the agency that issued the freeze, and a more senior officer decides. No court is involved.
If the release is approved, it eases the pressure. The rest of the money stays frozen, so plan as if the freeze is still running.
What to do first
Read your freeze notice and find the section it names. Keep your records in order and avoid anything that could widen the investigation.
A lawyer can read the notice with you, tell you which time limit applies, and prepare a written request to release money for living costs if you need it.

What decides how long my freeze lasts?
Does the 18-month AMLA limit mean I will get my money back at month 18?
Not necessarily. Section 52A lets the order lapse at 18 months only if you have not been charged by then [f2]. If you are charged, the money question moves into the court case, which has its own timeline. The Court of Appeal looked at this limit, when it was 12 months, in Lim Hui Jin v CIMB Bank Bhd & Ors [2018] [f5].
If my living expenses are released, is the freeze nearly over?
No. Section 44A lets you ask for money to be released for reasonable living and business costs [f3]. The request is made in writing to the agency that froze the account, not to a court. The rest of the money stays frozen.
Can I do anything to speed it up?
You cannot set the timeline, but you can avoid slowing it down. Keep the freeze notice and your records, and get advice early. Moving other money around in a panic can look like hiding it.
