Frozen Account Myths, Corrected
Some common ideas about frozen accounts are wrong: here is what is true.

When your own account is frozen, rumour can fill the gaps: who ordered it, who can lift it, and how long it lasts.
Wrong ideas can push you into panic, or into doing nothing. Here is what is true, one myth at a time.
Myth: a freeze means I am already charged
One fear is that a frozen account means a criminal charge. It does not.
A freeze is a step in an investigation. It blocks your money while a suspected link is checked, before anyone decides whether to charge you.
Treating the freeze as a charge can lead to panic, over-explaining or rushed moves. See it for what it is: an open question that you can respond to calmly.
Myth: the bank chose to freeze me, so the bank can fix it
It is natural to argue at the branch, thinking the bank made the decision and can undo it.
The bank is usually following an order. An AMLA (Anti-Money Laundering Act) section 50 order comes from the Public Prosecutor [f1]. A police freeze under section 116D comes from an officer of Sergeant rank or above, not from the bank [f3].
Bank Negara runs BNMLINK on 1-300-88-5465 for banking complaints [f5]. But the freeze itself is lifted through the law that imposed it, not by arguing at the counter.
Myth: it will unfreeze itself on a fixed day
Some people expect every freeze to end after the same number of days. There is no single clock.
An AMLA order lapses 18 months after it was made if no charge is brought [f2]. A section 44 freeze by an enforcement agency lasts up to 90 days unless you are charged. The Court of Appeal looked at this limit, when it was 12 months, in Lim Hui Jin v CIMB Bank Bhd & Ors [2018] [f4]. A police freeze under section 116D follows different rules [f3], so your timeline depends on which power applies.
Myth: nothing can be done until the police call
A freeze can feel like being put on hold, so it is easy to just wait and assume the next move belongs to the police.
Waiting costs time. You can read the notice, find the legal power, gather your records, and get advice now. For an AMLA freeze there are formal steps you can take, such as a written application to release money for living costs.
Myth: getting a lawyer will make me look guilty
Some people believe that asking for legal help is a sign of guilt, so an innocent person should handle it alone.
Speaking to a lawyer is a normal right, not an admission. A lawyer can explain the legal power behind your freeze, protect your position, and help you avoid panic mistakes.
Where to start
Find out which legal power applies to your account. It decides the time limit and your options. Read your freeze notice, keep the document, and write a simple timeline.
A lawyer can read the notice with you and, for an AMLA section 44 freeze, prepare the written application to release money for living costs. Ask based on your facts, not on rumour.

Does a frozen account mean I have already been charged?
No. A freeze is a step in an investigation, not a charge or a conviction. It blocks your money while a suspected link is checked, such as a victim's report or a flagged transfer. You can still explain yourself and get legal advice before answering questions.
The bank froze my account. Can the bank unfreeze it if I complain?
Not by itself. A freeze usually follows an order from the police or the Public Prosecutor, so the bank is carrying out an instruction. Bank Negara runs BNMLINK on 1-300-88-5465 for banking complaints [f5]. The freeze itself has to be dealt with through the law behind it.
Will my account unfreeze itself after a set number of days?
Nothing can be done until the police contact me, right?
Wrong. You can read the freeze notice to find the legal power, gather your records, and get advice early. For an AMLA freeze there are formal steps, such as applying to release money for living costs. Waiting for a call only costs time.
