Giving Your JSJK Statement: Practical Tips
How to prepare before you sit down with commercial crime investigators over a frozen account.

Who calls you in and why
When a bank account is flagged in a mule or scam case, the case can go to JSJK, the Commercial Crime Investigation Department at Bukit Aman [f1]. They trace how money moved and who controlled the account. You may get a call or a written notice to give a statement.
Being called in does not mean you are guilty. Investigators also speak to victims, witnesses and account holders who were tricked. Your job is to explain your side clearly and honestly.
The notice should give a date, a place and the officer to ask for. Go on time. If the date truly clashes with work or study, a lawyer can ask for another date for you.
Know your rights before you go
Article 5(3) of the Federal Constitution gives you the right to consult and be defended by a lawyer of your choice [f2]. Use it early. A short talk before the interview tells you what questions to expect and where you stand.
A lawyer cannot answer for you, but can prepare you. For example, knowing what Penal Code s424A covers (controlling someone else’s account) [f3] helps you see why certain questions are asked.
Tell the truth and keep it simple
Say what you know, and say plainly when you do not know or cannot remember. Do not guess dates, amounts or names to fill gaps.
Keep your answers short and factual. If a question is unclear, ask for it to be repeated. Pause rather than agree to something you are unsure about.
Do not guess at other people’s motives or describe things you did not see. If you were scammed, say so and describe what happened to you. A calm, consistent account is easier to stand behind later.
Bring documents that back you up
A statement is stronger with records behind it. Bring your identity card, any freeze notice or bank letter, and transaction records for the period in question.
If you were tricked, for example by a fake job offer that asked for your card or online banking login, bring those chats and adverts. Police detected 46,048 mule accounts in 2023 and 50,295 in 2024 [f4]. Your evidence helps show how you were drawn in.
What not to say or do
Do not delete messages, apps or transaction history, before or after the interview. Missing records can look worse than the records themselves.
Do not sign a statement you have not read or do not understand. You may read what was recorded. If something differs from what you said, ask for it to be corrected before you sign.
After the statement
Your statement goes into the investigation file. You may be called back, asked for more documents, or told the file is being reviewed for a charging decision. The freeze can stay in place while this happens.
A lawyer can help you reply to follow-up requests, gather the right documents and understand where the case may go next.
Keep a copy of everything you hand over and note the date. If you remember something important later, tell your lawyer so it is raised properly.

Can I bring a lawyer to my JSJK statement?
You have a constitutional right to consult a lawyer of your choice. Ask in advance whether a lawyer can be present while you are questioned. You can consult one before you go and afterwards, which helps you understand the questions and what to bring.
Do I have to answer every question?
You must answer the officer's questions, but the law lets you decline a question if the honest answer could expose you to a criminal charge. That line is hard to judge, so get advice first. Answer truthfully, never guess or make up details, and if you do not know or do not remember, say so.
What should I bring to the interview?
Your identity card, bank letters or freeze notices, transaction records, and proof of where the money in the account came from. If you were tricked into sharing card or login details, bring the chats or job advert. Put them in date order.
What happens after I give my statement?
It goes into the investigation file. Investigators may call you back, ask for more documents, or send the file for a charging decision. The freeze can stay in place while they work. A lawyer can help you reply to follow-up requests.
