Facing a Mule Case: Lawyer or No Lawyer
The gap between going it alone and having a lawyer shows up at the very first police interview.

A lawyer is not only for the guilty
When your account is frozen or the police call you in, it is tempting to think lawyers are only for guilty people. They are not. Innocent people can lose ground by going alone and assuming honesty will speak for itself.
The real comparison is not lawyer versus saving money. It is lawyer versus each stage where going alone can cost you without you noticing.
At the police statement
Without a lawyer, you go in alone and talk. You want to seem cooperative, so you explain how the account was opened, who you spoke to and what you thought was happening. Every word is written down.
With a lawyer, you still tell the truth, but you can prepare first and check that the statement is recorded accurately. Article 5(3) of the Federal Constitution protects your right to consult a lawyer of your choice. [f1]
The difference is not honesty. A rushed answer can add details that you were not sure of, and those details stay in the file.
When the freeze lands
Without a lawyer, the freeze feels total and it is easy to just wait. Bills go unpaid while they hope it sorts itself out.
With a lawyer, the freeze is a legal step with ways through it. If it is an AMLA s44 order, AMLA s44A lets you apply in writing to the enforcement agency to release money for reasonable living or business expenses. [f4] A more senior officer at the agency decides; no court is involved.
A police freeze under CPC s116D works differently. An officer of Sergeant rank or above can impose it at once, without a court order. [f3] To vary or revoke it, you apply to the Sessions Court. Knowing which power froze your account decides your next step, and that is hard to work out alone.
Reading the charge
Without a lawyer, a charge sheet is a wall of section numbers. You may not know that s424A, s424B and s424C carry very different penalties, or that the section chosen may not fit your facts.
With a lawyer, the first job is checking the charge against what happened. Section 424C covers transactions through an account without a lawful purpose. It carries 3 to 10 years in jail, or a fine of RM10,000 to RM150,000, or both. [f2]
Ask whether the section fits what actually happened.
Bail and the court process
Offences under s424A, s424B and s424C are bailable, so bail is your right. But the court or the police set the amount and the conditions.
Without a lawyer, you may have no surety ready and no one to put your ties to the community before the court. A lawyer can help you arrange a surety and present your ties to the court, which can help keep the amount and conditions reasonable.

If money is why you would go alone
If private fees are out of reach, do not face questioning alone. Check Legal Aid first.
The Legal Aid Department (Jabatan Bantuan Guaman) may give help at low or no cost to people who meet its income rules. [f5] Ask about eligibility before you give a full statement, not after.

Can I just tell the police I am innocent and skip a lawyer?
You can, but what you say is written into the file, and the rules on how a statement may be used later are technical. It is easy to explain too much and get stuck with a version you regret. A lawyer does not stop you telling the truth; they help keep your statement accurate and fairly taken. [f1]
Is a lawyer worth it if only a small amount passed through?
A small sum can still be charged under Penal Code s424A to s424C, and s424C carries up to 10 years in jail. The amount does not decide which section you face. A lawyer checks the charge against the facts. [f2]
What can a lawyer do about the freeze on my account?
If the freeze is an AMLA s44 order, AMLA s44A lets you apply in writing to the enforcement agency that issued it to release money for reasonable living or business expenses. A senior officer there decides; no court is involved. A lawyer prepares the application with proof of your expenses. [f4]
I cannot afford private fees. Do I have to go without a lawyer?
Not necessarily. The Legal Aid Department may give help at low or no cost to people who meet its income rules. Ask about eligibility early, before you give a full statement. [f5]
