Your Rights When Police Seize Your Phone
What to expect if police take your phone, and what you can reasonably ask for.

What a seizure is
A seizure is when police take an item they believe is relevant to an investigation. In a mule-account case, your phone can be, because it may hold messages and banking activity.
The seizure is the moment the phone leaves your hands. Any forensic check of what is on it comes later.
Stay calm and do not resist
If officers move to take your phone, do not resist physically. That can add a new problem to the case you already face.
Stay calm and let it happen, and use the moment to watch and remember. The Commercial Crime Investigation Department (CCID) at Bukit Aman handles mule-account investigations [f2].
Your right to a lawyer
Article 5(3) of the Federal Constitution gives you the right to consult and be defended by a lawyer of your choice [f1]. You can say clearly that you want to speak to a lawyer.
This matters most for decisions like unlocking the phone or giving your passcode. You are entitled to get advice before you decide.
Asking for legal advice is not being difficult. It is using a right that exists for exactly this moment.
What not to do
Do not wipe, reset or destroy the phone. Tampering with possible evidence is a separate, serious problem, and it can delete records that help explain your side.
Do not make up explanations on the spot or guess answers under pressure. You can say you want legal advice first.
Police detected 46,048 mule accounts in 2023 and 50,295 in 2024 [f4]. Some account holders were used without knowing, and a calm response helps you more than panic.
Ask for a record of what was taken
You can ask for a receipt or a list of the items seized. If you get one, keep it safe.
Write down the date, time and place, and the officers’ names or ID if given. Note what you were told and what you were asked.
These notes let a lawyer see what happened and check that the seizure was done properly.
Why this protects you later
A seized phone can become evidence in a case that may lead to a charge such as Penal Code section 424C. That offence carries 3 to 10 years jail, or a fine of RM10,000 to RM150,000, or both [f3].
How the seizure was handled can matter. Notes made at the time are more reliable than memory blurred by stress.
The days after your phone is taken
Losing your phone is unsettling, especially if it holds your contacts and banking apps. Write down everything you remember about the seizure, on paper or another device, while it is fresh.
Tell a lawyer soon and share those notes. A lawyer can explain what to expect from CCID [f2] and whether asking for the phone back is realistic yet.
Do not contact the people who got you involved, and do not try to warn anyone.
Expect the phone to be held for a while. Set up a basic spare for essentials, and reset any locked-out logins through the bank’s or provider’s official channels, keeping a note of each change.
Gather any backups from before the seizure, such as cloud copies of chats or statements. They help rebuild your timeline without touching the seized phone.

Can police take my phone as part of an investigation?
Police can seize items they believe are relevant to an investigation, and in a mule-account case a phone can be. Do not resist physically. Stay calm, let them take it, and note what was taken and by whom.
Should I unlock it or give my passcode?
You have the right to consult a lawyer before deciding, and you can say clearly that you want to. Do not wipe or destroy the phone, because that creates a new problem. Get legal advice on what to provide, instead of deciding alone under pressure.
Can I get my phone back?
A seized phone can be kept while the investigation and any examination continue, so it may not come back soon. There may be a way to apply for its release, and a lawyer can tell you if and when that is realistic. Do not count on a date nobody has given you.
What should I write down after a seizure?
Write the date, time and place, the officers' names or ID if given, and any receipt or list of items you received. Note what you were told and what you were asked. Notes made while it is fresh help your lawyer check that the process was done properly.
