When a freeze begins

A freeze can start in more than one way. Under CPC section 116D, a police officer of Sergeant rank or above can freeze money in an account without a court order, if the account is suspected to be linked to unlawful activity [f1].

A freeze can also come under AMLA. Section 50(1) lets the Public Prosecutor order a freeze on accounts suspected of holding proceeds of unlawful activity [f2].

Which power was used matters, because each has its own time limit and its own way to challenge it.

Finding out and finding the reason

The first sign can be a failed payment, not a letter. You may only learn of the freeze when a transfer bounces or the app blocks you.

Next, find out which power froze the account. A police freeze and an AMLA freeze follow different rules, so this decides your next steps.

Write down the date you first noticed the block and keep your bank messages and statements. A lawyer can use them to read your situation.

The time limits

An AMLA freeze does not run forever. A freeze by an enforcement agency under s44 ends after 90 days if you are not charged. A seizure order under s52A lapses 18 months after it is made, or after an earlier freezing order, if you are not charged or no prosecution is started [f3].

A police freeze under s116D also lapses 18 months after the order if no one has been prosecuted for an offence linked to the money. Counting from the order date helps you plan instead of panic.

Applying to release money

You are not powerless while the account is frozen. Under AMLA s44A you can apply in writing to the agency that froze it, to release money for reasonable living or business costs [f4]. A more senior officer decides, and no court is involved.

For a police freeze under s116D, you apply to the Sessions Court to vary or revoke the order.

Neither is automatic. Show with documents that the costs are real and reasonable. A lawyer can prepare the application and present it clearly.

How a freeze ends

A freeze can end in three ways. It can lapse when the time limit passes with no charge, it can be lifted after an application, or you can be charged.

A lapse ends the freeze. A charge moves the focus to the criminal case, which has its own timeline. Keep the two questions apart: the money, and your liberty.

What to do while the freeze runs

Keep your records in order and note any real hardship the freeze causes, such as rent, loan instalments or staff pay. That evidence supports a release application.

Do not move money in ways that look like dodging the freeze, and do not use someone else’s account to receive your money. Ignore strangers who promise a quick unfreeze for a fee.

Instead, find out which power was used and what options you have. A lawyer can confirm the basis of your freeze, which every later step depends on.

How long can my account stay frozen?

It depends on who froze it. An agency freeze under s44 ends after 90 days if you are not charged. A seizure order under AMLA s52A lapses if you are not charged within 18 months [f3]. A police freeze under CPC s116D lapses after 18 months without a prosecution. Check which power was used.

Can I get some money out while the account is frozen?

Possibly. Under AMLA s44A you can apply in writing to the agency that froze the account, asking to release money for reasonable living or business costs [f4]. A more senior officer decides, and it is not automatic. A lawyer can help you prepare the application and the papers behind it.

Does a freeze mean I have been charged?

No. A freeze is about the money, not a criminal charge against you. It can be made on suspicion, before anyone decides to prosecute, and a freeze can end without any charge. The freeze and a criminal case run separately, so treat them as two different questions.

What happens when the freeze ends?

It can lapse when the time limit passes with no charge. It can be lifted or varied after an application. Or you can be charged, which moves the matter into a criminal case. Which of these applies depends on the facts and the power used.
