What is the difference between frozen and suspended?

A freeze usually comes from a legal order or a police investigation. A suspension is more often the bank’s own hold. The real difference is who made the decision, because that is who you have to deal with to lift it.

Banks do not use these words consistently, so do not judge by the label on a letter or app. Ask who ordered the hold and under what law.

A legal freeze is ordered by an authority outside the bank. Under AMLA section 50(1), the Public Prosecutor can order a freeze on accounts suspected of holding proceeds of crime [f1].

A police officer of Sergeant rank or above can also freeze an account at once, without a court order, under section 116D [f2]. An enforcement agency can also freeze under AMLA section 44. [f5] In each case the bank is following an instruction, not making its own choice.

A bank suspension

A suspension is often the bank acting on its own. Common triggers are suspected fraud on the account, missing identity checks, or a security concern. No court or investigating authority is behind it.

Because the bank made the decision, the bank is usually the place to sort it out. That is a very different route from dealing with the police or another authority.

Why the difference changes your next step

Confirm the type before you act. Ask the bank in writing for the legal basis and who ordered the hold. An AMLA seizure order, for example, lapses if the person is not charged within 18 months under section 52A [f3], and an agency freeze under section 44 ends after 90 days without a charge [f5].

For a bank suspension, complain to the bank first, then to BNMLINK on 1-300-88-5465 if it is not resolved [f4]. For a freeze linked to an investigation, get legal advice first. A lawyer can find out which power was used and what can be done to challenge it.

Does the word on my letter actually matter?

Yes, but do not rely on the word alone, because banks use both terms loosely. Ask the bank in writing for the legal basis and who ordered the hold. If it names police action under section 116D or an AMLA order, it is a freeze linked to an investigation, not a routine bank suspension [f2] [f1].

Can a freeze last forever?

An AMLA freeze cannot. An agency freeze under section 44 ends after 90 days if the person is not charged, and under section 52A a seizure order lapses after 18 months without a charge. Other holds, such as a bank's own suspension, follow their own rules. Confirm which type you have before you count on any timeline.

Who do I contact for each type?

For a bank suspension, complain to the bank first. If that does not resolve it, contact Bank Negara through BNMLINK on 1-300-88-5465 [f4]. For a freeze linked to an investigation, the decision sits with the authority behind it, so get legal advice before you give the police a detailed statement.
