How do I prove I did not know?
Saying “I did not know” again and again is not enough. You show it with records and dates. What you knew and why you acted matter to your defence, so evidence of what you believed at the time carries weight.
That means collecting the messages and records that explain why you acted as you did, and keeping them safe.
Evidence of what you believed
Start with how it began. Keep the job advert, rental listing, investment offer or friend’s request that led you to open the account or hand over access, with the dates.
Section 424B covers giving control of your own account to someone else without lawful authority or lawful purpose [f1]. Messages promising a salary, commission or a favour can help show what you thought you were doing and why.
Why the order of events matters
The order of events links what you did to what you knew. If you gave access before any suspicious transfer, and your messages show you expected something ordinary, that order supports you.
Bank statements, transfer records and screenshots let a lawyer match dates against what you were told. A clear timeline is far stronger than simply saying you did not know.
What you knew and the offence charged
What you knew and why you acted matter to your defence. Section 424A covers possessing or controlling someone else’s account without lawful authority [f2]. Your evidence is how a lawyer tests whether the facts fit the section charged.
You do not have to prove your innocence from nothing. You give a believable account and back it up. Under Article 5(3) you can have a lawyer of your choice defend you and help prepare that account [f3].
If you have already deleted messages, stop deleting anything. Write down what you remember, with dates, before you give a statement.

What kind of evidence shows I did not know?
Anything that shows what you believed at the time. Keep the job advert, rental listing or friend's message that led you to open or share the account, with dates and any payment you expected [f1]. Bank records and screenshots that match your story carry more weight than words alone.
Isn't it up to me to prove my innocence?
No. The prosecution must prove its case. What you knew and why you acted matter to your defence, so give a believable account and back it up with evidence. Under Article 5(3) you can have a lawyer help you set it out clearly [f3].
I already deleted the messages. What now?
Do not panic. Some records may be recoverable from the other person, the app or your bank, and a consistent account still counts [f1]. Stop deleting anything. Write down what you remember, with dates, and get advice before you give your statement.
