A frozen Penang account has a time limit

An AMLA freeze is not permanent. The count starts on the date of the order.

Knowing how much time has passed changes what you should do now.

The freeze laws are federal, so the same limit applies across Penang, in George Town, Butterworth and Bukit Mertajam. What is local is which offices and courts you deal with.

The 18-month limit under section 52A

The main rule: under AMLA section 52A, an order under section 50 lapses after 18 months if no one is charged in that time. [f1] A freeze by an enforcement agency under section 44 is shorter: up to 90 days unless a charge is brought.

A police freeze under Criminal Procedure Code section 116D has its own rules, and it can be made at once, with no court order. [f5] A lawyer first finds out which power was used, then works out the dates.

The freeze duration guide sets out each time limit in more detail.

What the courts have said about the limit

The limit has been tested in court. In Lim Hui Jin v CIMB Bank Bhd and Others, decided in 2018, the Court of Appeal dealt with the time limit on an AMLA freeze, which was 12 months then (18 months since 1 March 2026). [f3]

This case is useful when a freeze seems to have run its full term. A lawyer can check your dates and the state of any investigation against it.

Why the account was frozen

Every freeze has a trigger. Under AMLA section 50(1), the Public Prosecutor can order a freeze on accounts suspected of holding money from crime. [f2]

A scam victim’s report can start this. A report does not prove guilt, but it explains why your account was named and shapes your response. The account freezes explainer covers both powers.

Asking for living costs while you wait

It is hard to wait out a freeze with no money at all. If an enforcement agency froze the account under AMLA section 44, section 44A lets you apply to release money for reasonable living or business costs. [f4]

You apply in writing to that agency, and a more senior officer decides based on your papers. Approval is not automatic, so a lawyer can build the request around your real monthly bills. Your account holder rights page explains the limits.

Who you deal with after a Penang freeze

Start with the bank’s letter, which should name the authority behind the freeze. If police are involved, the Pulau Pinang police contingent (IPK) is on Jalan Penang, with district headquarters (IPD) Timur Laut, Barat Daya, Seberang Prai Utara, Tengah and Selatan. [f6]

The Commercial Crime Investigation Department is a national police department, not a Penang office. The High Court of Pulau Pinang sits at Kompleks Mahkamah Pulau Pinang. [f7] The prosecution chooses the court for any charge, so read it off the charge sheet.

If cost is a worry, the Legal Aid Department (Jabatan Bantuan Guaman) lists a Penang office for people within its income limits. [f8]

The Penang page covers the rest of the state.

How long can my Penang account stay frozen?

Not for ever. A freeze by an enforcement agency under section 44 lasts up to 90 days unless a charge is brought. Under section 52A, an order under section 50 lapses after 18 months if no one is charged. A police freeze under CPC section 116D also lapses after 18 months if no one is prosecuted, counted from its own start date. A lawyer can find out which power applies and note the date. [f1]

Has a court looked at the time limit?

Yes. In Lim Hui Jin v CIMB Bank Bhd and Others, decided in 2018, the Court of Appeal dealt with the time limit on an AMLA freeze, which was 12 months then (18 months since 1 March 2026). It is useful when a freeze seems to have run its full term. A lawyer can check your dates against it. [f3]

Which Penang police office handles my freeze?

The letter should name the office. The police contingent (IPK) is on Jalan Penang, with five district headquarters (IPD): Timur Laut, Barat Daya, Seberang Prai Utara, Tengah and Selatan. Ask the bank for the freeze reference and which authority issued it.

Can I get money released before the time runs out?

Sometimes. If an enforcement agency froze the account under AMLA section 44, section 44A lets you apply in writing to that agency to release money for reasonable living or business costs. A more senior officer decides, based on your papers. This means you do not have to wait 18 months with nothing. [f4]

Why was the account frozen at all?

It can follow a report. Under AMLA section 50, the Public Prosecutor can order a freeze on money suspected to come from crime. A police officer of Sergeant rank or above can also freeze an account under CPC section 116D, with no court order. A scam victim's report can start this, but it does not prove guilt. [f5]
