What does actus reus mean?

Actus reus is the guilty act, the physical side of an offence. It is the conduct, circumstance or result that the law forbids, meaning what was actually done in the outside world.

Mens rea is the state of mind behind it.

It is easy to assume the act settles everything in an account case. It does not. The act must match the exact offence, and for most offences a guilty mind must also be shown.

How is the act different from the mind?

An offence has two parts working together. The actus reus is the physical side, the doing. The mens rea is the mental side, the intention or knowledge behind it.

The section charged defines which act the prosecution must prove. Giving control of your own account to someone else is the act in s424B: a fine of RM10,000 to RM100,000, or jail of 1 to 7 years, or both [f1].

Possessing another person’s account without authority is the act in s424A [f2]. The alleged conduct must fit the section, not just look similar.

Why is the act alone rarely enough?

Even a clear act may not prove guilt on its own. Most offences also need the mental element, so an accused can argue that intention or knowledge was missing, for example where they were genuinely deceived.

That is why the physical evidence should be tested, not simply accepted. You have the right to consult and be defended by a lawyer of your choice [f3]. A lawyer can test the alleged act against the exact section, so a broad claim about your account is not treated as the whole case.

If my account was used, is that the actus reus?

Perhaps in part. The act must still match what the specific offence describes, and for most offences a guilty mind must also be shown. Money moving through your account may show conduct, but whether it fits the offence, and whether you had guilty knowledge, are separate questions.

Is doing the act enough to be guilty?

Not by itself. Most offences need both the guilty act and a guilty mind. Even where the act is clear, an accused can argue the mental element was missing, for example because they were genuinely deceived.

How is the act proved in an account case?

The prosecution uses records such as bank movements, documents and statements to show what physically happened. These can be examined and challenged. A lawyer can test whether the conduct alleged really fits the section charged.
