What the Magistrates’ Court is

The Magistrates’ Court is a lower criminal court. It generally hears less serious offences and handles the early stages of a case. It sits at the base of the court structure, below the Sessions Court and the High Court.

It is a stage in a process, not a verdict on you.

Where it sits among the courts

The criminal courts form a ladder, and the prosecution decides which court hears a charge. A Magistrates’ Court can try each of the mule-account offences. They differ in penalty. Penal Code section 424A, possessing or controlling another person’s account without lawful authority, carries a fine of RM5,000 to RM50,000, or 6 months to 5 years jail, or both. [f1]

Section 424B covers surrendering control of your own account to another. It carries 1 to 7 years jail, or a fine of RM10,000 to RM100,000, or both. [f2]

Why the court level matters to you

The court level is background only. It does not decide the outcome and it does not mean you are guilty.

What matters more is being prepared and having a lawyer, whichever court your matter reaches. Our page on the investigation and court process shows the wider picture.

Your right to a lawyer

This right applies at every court level. Article 5(3) of the Federal Constitution gives you the right to consult and be defended by a lawyer of your choice. [f3]

Use it early. A lawyer can explain the stage you are at, help you prepare documents and keep you from errors made under pressure.
