What the High Court is
The High Court hears the most serious cases and appeals from the lower courts. It sits above both the Sessions Court and the Magistrates’ Court. A matter can reach it because the charge is serious or because someone is appealing a decision.
The court level is a stage in the process. It is not a verdict on you.
Where it sits among the courts
Criminal courts are ranked, with the High Court above the Sessions Court and the Magistrates’ Court. The heaviest mule-account offence is Penal Code section 424C, making transactions through an account without a lawful purpose. It carries 3 to 10 years jail, or a fine of RM10,000 to RM150,000, or both. [f1]
The prosecution decides which court hears the charge, and the lower courts can try offences of this size. The High Court may come in later, for example on appeal.
Its role in appeals
The High Court and the courts above it also review decisions. In Lim Hui Jin v CIMB Bank Bhd & Ors [2018], the Court of Appeal addressed the 12-month (then in force; 18 months since 1 March 2026) AMLA freeze limit. It shows how account matters can reach the higher courts. [f2]
So a dispute over a freeze or a possible forfeiture can, in some cases, be tested at a higher level.
Why this matters to you
Article 5(3) of the Federal Constitution gives you the right to consult and be defended by a lawyer of your choice. [f3]
If your case is serious or may go on appeal, a lawyer can explain which court it will be in and what happens there. You can also read our page on the investigation and court process to see where you stand.

What is the High Court?
It is a superior court above the Sessions Court and the Magistrates' Court. It hears the most serious cases and appeals from the lower courts. Being heard there says how serious the matter is, not whether anyone is guilty.
Would a mule-account case reach the High Court?
The prosecution decides which court hears a mule-account charge, and the lower courts can try these offences. The High Court may come in later, for example on appeal or in a dispute over frozen money, as in Lim Hui Jin v CIMB Bank. A lawyer can explain the likely path in your case.
Why does the High Court matter to me?
Serious cases and appeals are decided there, and those decisions shape how the law is applied. Article 5(3) of the Federal Constitution gives you the right to a lawyer of your choice.
