What it means

A Sessions Court is a criminal court above the Magistrates’ Court and below the High Court. It hears more serious offences than the lower court. In a mule-account case, a charge may be heard here instead of the Magistrates’ Court, because the prosecution chooses the court.

It is a stage in the process, not a finding about you.

Where it sits among the courts

The prosecution decides which court hears a charge. Penal Code s424B, giving control of your own account to another person, carries a fine of RM10,000 to RM100,000, or 1 to 7 years in jail, or both [f1].

The most serious of the three is s424C, transactions through an account without a lawful purpose, with a fine of RM10,000 to RM150,000, or 3 to 10 years in jail, or both [f2].

Why your case might be here

If your case is listed at the Sessions Court, it does not mean any decision has already been made about you. Which section is alleged matters, so find out.

Read our page on the investigation and court process to see how the stages connect, and compare the lower Magistrates’ Court.

Other things this court decides

If police froze your account under CPC s116D, the person named in the order can apply to the Sessions Court to vary or revoke it. The court looks at good-faith debts and reasonable living expenses.

Why a lawyer matters here

A Sessions Court can pass heavier sentences than a Magistrates’ Court. You have the right to consult and be defended by a lawyer of your choice [f3]. A lawyer can explain the charge, prepare your documents, and present your position clearly, so use that right early.

What is a Sessions Court?

A Sessions Court is a criminal court above the Magistrates' Court and below the High Court. It hears more serious offences than a Magistrates' Court. A Sessions Court can try all the mule-account offences, and the prosecution decides which court hears a charge. The court level is not a decision about guilt.

Why might my case be in the Sessions Court?

The prosecution decides which court hears a charge, so the court level does not by itself show how serious your case is. If your case is listed here, find out which section is alleged. A lawyer can explain what it means for you.

Is a lawyer more important at this level?

A lawyer matters at every level. Article 5(3) of the Federal Constitution gives you the right to consult and be defended by a lawyer of your choice. The possible penalties here are significant, so understanding the charge and preparing with a lawyer is important.
