What it means

The prosecution case is everything the prosecution brings to court to prove a charge: the witnesses it calls, the documents it produces and the arguments it makes. In a mule-account matter, a Deputy Public Prosecutor runs it.

It is built to prove one charge under one section of the law. Penal Code s424C is the most serious mule offence, with a fine of RM10,000 to RM150,000, or 3 to 10 years in jail, or both [f1]. To prove it, the prosecution must show transactions went through an account without a lawful purpose.

What the prosecution must prove

The burden of proof is on the prosecution. It must prove every element of the offence beyond reasonable doubt. Showing that your account existed, or that money moved through it, is not enough on its own.

The section on the charge sheet sets out what must be proven. Mule accounts are a large enforcement area: police detected 46,048 mule accounts in 2023 and 50,295 in 2024 [f2]. Even so, each element of your own charge must still be proven.

Where the defence comes in

The prosecution case is only the first half of the court process. When it ends, the court decides whether there is a case to answer. Only then is the defence heard.

You have the right to consult and be defended by a lawyer of your choice [f3]. The Malaysian Bar sets standards for how lawyers charge and act, so you can ask about costs openly [f4]. A lawyer can read your charge sheet and tell you what the prosecution must prove and what you should prepare.

What standard does the prosecution have to meet?

It must prove every element of the charge beyond reasonable doubt. Showing that your account was used, or that money passed through it, is not enough on its own. The section charged sets out the elements. What you knew and why you acted can matter to your defence.

Does the prosecution case decide my guilt?

No. It is only one side. When it ends, the court decides whether there is a case to answer. If there is, the defence is heard before any verdict. Nothing is settled until all the evidence has been tested in court.

Why does the charged section matter so much?

Each mule-account section has different elements and penalties. Section 424C is the most serious. The prosecution must prove the section on the charge sheet. Knowing which section you face is where any defence starts.
