What is a charge sheet?

A charge sheet is the formal written document that tells you exactly which offence you are accused of. It names the section of law, the date and place of the alleged act, and the account or instrument involved. In a mule-account case this is a charge under the Penal Code. [f1]

The charge is read out to you in court and interpreted into a language you understand. Being handed a charge sheet does not make you guilty. The prosecution must still prove the charge beyond reasonable doubt.

Why does the exact section matter?

The section on the sheet decides the penalty and the kind of defence open to you. Having or controlling someone else’s account is charged differently from handing over your own. Penal Code s424A carries a fine of RM5,000 to RM50,000, or jail of 6 months to 5 years, or both. [f1]

Police detected 46,048 mule accounts in 2023 and 50,295 in 2024, but what applies to you is the exact wording of your own charge. [f2] Two people can be arrested over the same transfer and face different sections.

What should I do with it?

Read every line. Check your name, the date, the place and the account number against what you know. Note anything that does not match.

You have the right to consult and be defended by a lawyer of your choice under the Federal Constitution. [f3] You can ask the court for time to get legal advice before you respond, so you are not forced to plead on the spot.

Keep the document safe and take a clear photo. A lawyer can compare the wording with the facts and explain in plain words what the prosecution must show.

When do I receive the charge sheet?

You see it when you are formally charged in court. The charge is read out and interpreted in a language you understand. You do not have to plead straight away, and you can ask the court for time to get a lawyer first.

Does a charge sheet mean I am guilty?

No. A charge sheet is only an accusation that the prosecution still has to prove. You are presumed innocent until the court decides otherwise. The exact section matters, because the penalty and the defence differ between Penal Code s424A, s424B and s424C.

What should I check on the charge sheet?

Check your name and details, the date and place of the alleged offence, the exact section of law, and the account or instrument named. Any error can matter. Take the sheet to a lawyer, who can compare the wording with what really happened before you decide how to respond.
