Why insurance agents get flagged

Insurance agents collect premiums from clients and pass them on to the insurer. A busy agent may receive payments from many people each month. [f2] The bank sees money arriving from many unrelated people, which is exactly the pattern compliance systems are built to flag.

It is worse when premiums go into a personal account instead of a company trust account. [f3] An account opened for a salary that suddenly receives transfers from many different people every month raises questions the bank’s system cannot answer by itself.

As a BNM-licensed agent regulated under the Financial Services Act 2013, collecting premiums is a normal part of your work. [f1] But the bank’s automated monitoring does not check your licence. It only sees the pattern, and yours can look suspicious.

How the freeze affects your work

A frozen account causes trouble on several fronts. Client premiums in the account cannot reach the insurer, and late premiums can make policies lapse. Your clients could lose their cover without knowing why.

Your commission is locked too, because the insurer’s payments cannot reach a frozen account. Meanwhile, your agency may ask why premiums are not coming through, which puts your contract at risk.

Each day the freeze goes on, it gets more complicated. Clients call about their policies, the insurer expects its premiums and your income stops. That is why you should get a lawyer involved quickly.

How the AMLA freeze works

Under AMLA 2001, an enforcement agency can freeze your account for up to 90 days, unless you are charged, while it checks where the money came from and what it was for. [f4] The freeze blocks all transactions, so you cannot withdraw, deposit or transfer money.

The freeze is not a criminal charge. It is an investigation tool to check whether the money comes from lawful sources. For insurance agents, the check looks at whether the deposits are client premiums.

The key is clear records that link every deposit to a specific client and policy. This is where your professional records work in your favour.

Your records are your strength

If you keep detailed records, they can show your account activity is lawful. [f5] Every premium is tied to a client, a policy number and a period of cover, and a lawyer can use that paper trail.

Agency agreement. Your contract with the insurer shows you are authorised to collect premiums for it. This explains why the payments come in.

Client policy records. Each policy has a set premium and payment schedule. These records match deposits in your account to named clients and valid policies.

Commission statements. The insurer’s monthly commission reports tie your earnings to specific policies.

Premium receipts. Receipts you issued when collecting premiums add one more layer of proof.

What to do right now

Contact a lawyer who handles business account freezes straight away. Client policies may be about to lapse, so speed matters. The lawyer can start work on releasing the account and advise how to protect your clients’ cover.

Tell your agency supervisor. Your team leader or branch manager needs to know. They can arrange another way to collect premiums and give supporting papers for your case.

Gather your records. Your agency agreement, client policy lists, premium records, commission statements and any receipts you issued. A lawyer uses these to build a source-of-funds submission, supported by a full evidence file, showing every deposit has a lawful origin.

List the clients affected. Note which clients’ premiums are in the frozen account and whose policies may lapse. A lawyer can put these first when asking for money to be released.

Keep your BNM licence in order. Your licensed status helps you here. Make sure it is current and have copies of your registration papers ready.

How a lawyer handles an insurance agent freeze

A lawyer prepares a formal submission to the investigating authority. It shows your account activity fits a licensed agent collecting client premiums.

It can include your BNM licence and agency agreement, a table matching each deposit to a client and policy, the insurer’s commission statements and a short explanation of how premium collection works. [f5]

Strong paperwork helps here. Every payment has a matching policy, every client can be named and every commission is on the insurer’s records.

If policies are at risk, a lawyer can apply in writing to the enforcement agency under AMLA section 44A to vary the order so the premium money can reach the insurer. A more senior officer in the agency decides.

Protecting your career for the long term

Once the freeze is over, take steps so it does not happen again. If you collect premiums through a personal account, ask your agency whether premiums should go through the company trust account instead of a personal account. [f3]

Tell your bank what your work involves, so its compliance team understands your transaction pattern. Keep your records in order so every deposit can be traced to a client and policy at any time.

A short talk with a lawyer about how you collect and record premiums can lower the risk of another freeze.

Why was my insurance agent account frozen?

Banks flag accounts that receive regular payments from many different people. As an agent, you may collect premiums from many clients every month. To a compliance system, that many incoming transfers can look like money laundering, even when every payment is genuine.

I am a licensed agent. Does BNM know about my situation?

The freeze is ordered by an enforcement agency such as the police, not by BNM acting as your licensing body. Your BNM licence is evidence that your work is lawful. A lawyer can point to it in the application to show that collecting premiums is part of your authorised work.

What happens to my clients' premiums in the frozen account?

Premiums you collected but have not yet passed to the insurer are stuck in the account. If the insurer does not receive them on time, policies can lapse. A lawyer can apply in writing to the enforcement agency to release that money, and can point out where a client's cover is at risk. The agency decides.

Could my agency terminate my contract because of the freeze?

Agency contracts differ, so check yours. Being open with your agency supervisor helps. A lawyer can advise how to tell your agency in a way that protects your position.

How long will the freeze last?

A freeze under AMLA section 44 can last up to 90 days, and ends sooner if you are charged or the agency varies or revokes it. [f4] A later seizure order lapses after 18 months if you are not charged. Clear records and a written application to the agency can help.

Should I collect premiums in cash during the freeze?

Handling cash premiums carries its own compliance risks and may break your agency agreement. Ask your agency about a temporary way to collect instead. A lawyer can also advise on proper arrangements during the investigation.

Can I still sell insurance policies during the freeze?

The freeze applies to your bank account, not your insurance licence. Check with your agency before you continue selling, and work out another way to collect premiums with your agency and lawyer.
