Why do workshop accounts get flagged?

Many car repair jobs are paid in cash. One customer pays a large sum in cash for an engine swap. Another pays less for brakes and suspension.

A third pays in cash for body work. You bank all of it, sometimes in the same week.

The bank’s monitoring system notices this pattern. [f1] Large, irregular cash deposits into a personal account do not look like a salaried worker’s account. [f2] Once cash deposits reach RM25,000 or more, the bank must report them.

The bank may not call to ask about your workshop. It can file a Suspicious Transaction Report, and the authorities may issue a freeze order under AMLA Section 44. [f3] Your account can be locked before anyone checks whether the money came from real repair jobs.

How does the freeze hit your workshop?

A frozen account stops the business. You need it to pay for parts, wages, rent and bills. Suppliers stop giving credit, and your workers still need to be paid.

The freeze does not touch your business licence or stop you taking new jobs. You can keep working, but you cannot use the money in the frozen account. Until it is sorted, cash on hand is what keeps you going.

If you use one account for business and personal money, the freeze is worse, because it locks everything: business funds, savings and any salary from other work.

Which records prove your income?

Your workshop creates proof every day. [f4] Start with your SSM registration certificate, which shows the business is registered. Add your local council workshop licence if you have one.

Job cards and invoices can be strong proof. Each one shows the customer, the vehicle, the work done, the parts used and the price. Match each one to a deposit in your bank statement, because that link is what investigators want to see.

Parts receipts help too. They show your spending fits a working repair business. If a parts purchase and a customer payment fall in the same week, the link is easy to see.

Put together a source-of-funds file linking each large deposit to a repair job. A clear evidence file helps the investigator check your income.

Can you get money released while the case is open?

Yes, you can ask for part of the money to be released. [f5] Under AMLA Section 44A, a freeze by an enforcement agency can be varied on your written application to that agency, so you can pay essential business and family costs.

For an AMLA s44 freeze, this is a written application to the agency that issued it, and a more senior officer decides. No court is involved. If the police froze the account under CPC s116D instead, you apply to the Sessions Court.

Your lawyer can prepare the application with your monthly costs: parts, wages, rent, bills and your family’s living costs. Supporting documents make it stronger.

What should you do right now?

Gather your business records. SSM registration, workshop licence, job cards, invoices, parts receipts and staff records. Digital copies are fine.

Download your bank statements. Get the last 12 months if you still have online access. Mark each cash deposit with its job number or customer.

Keep full records from today. Write a job card for every repair, issue an invoice for every payment, and file parts receipts by date. Good records now show you are cooperating.

Talk to a lawyer before your police statement. What you do in the first hours after finding the freeze shapes the case. A lawyer can help you explain your workshop clearly, so get legal help early.

Why was my workshop account frozen for receiving cash payments?

Banks flag accounts that take in large, irregular cash deposits. A few large cash jobs in one week can look suspicious to the bank's system. The flag is automatic, not personal.

I use a personal account for my workshop. Does that matter?

Yes. A personal account taking in business-sized cash deposits can look more suspicious than a registered business account. That mismatch can set off the flag.

What documents can I use to prove my workshop income?

Your SSM registration, workshop licence, job cards or invoices, parts receipts and staff payroll records. Quotations signed by customers and photos of finished repairs add further weight.

Can I still buy parts and pay staff while my account is frozen?

Not from the frozen account. Under AMLA Section 44A you can apply to vary the freeze so money is released for running the business. That is a written application to the agency that issued the freeze, and a more senior officer decides. Meanwhile, cash on hand can keep the workshop going. Do not use anyone else's account to receive or hold your money.

How do I prevent this from happening again?

Once the freeze is sorted, ask your bank about using a business account under your SSM-registered name instead of a personal account. Tell your bank you run a cash-heavy repair business. Keep records that tie each cash deposit to a job, so your account matches what your business really does.
