Same law as the Peninsula, different distances
Penal Code sections 424A to 424C are federal and apply in Sarawak as they do elsewhere [f1]. Section 424A, holding or controlling someone else’s account, carries a fine of RM5,000 to RM50,000, 6 months to 5 years in jail, or both [f1].
If money is seized under the anti-money laundering law (AMLA), the order lapses after 18 months if you are not charged [f2].
If police call you in
The office handling your file may be IPK Sarawak in Kuching or a district office such as Sibu, Miri, Bintulu or Limbang [f4]. It may not be the one closest to your home.
Ask which office, which officer and which date. You have the right to consult a lawyer of your choice [f3]. Speak to one before you attend, not after.
If you are arrested
A magistrate may allow police detention of up to 4 days first, then up to 3 days on a second application, for these offences [f5]. Your lawyer can make representations at that hearing.
Bail is a right, because these offences are bailable. The court or police set the amount and conditions [f6]. Stay away from anyone who guarantees a result or wants cash outside the court process.
Which court may hear it
A criminal case can start in the Magistrates’ Court or the Sessions Court, and the prosecution decides which. Sarawak has High Courts at Kuching, Sibu, Miri, Sri Aman, Bintulu and Limbang [f7].
Find out early where and when you must attend, and plan the journey so you do not miss a date. The Sarawak page has more on local offices.
Finding a lawyer from a distance
If you are considering legal representation, request independent lawyer contact on WhatsApp with a brief, general message and no documents. Ask whether the lawyer appears in the Sarawak courts and in which town. See what a lawyer can do.
Your wider protections are in account holder rights.
Fees and legal aid
Fees depend on the section and how much of the case is disputed. Ask for an estimate before you agree to anything.
The Legal Aid Department (JBG) lists offices for Sarawak, Sibu and Miri [f8], and may help if your income qualifies [f9]. For a fuller breakdown, see mule account legal cost.

Is a Sarawak mule account case governed by the same law as the Peninsula?
Yes. Penal Code sections 424A to 424C are federal, so they apply in Sarawak as they do elsewhere [f1]. What changes is the practical side: which police office, which court, and how far you must travel.
Police asked me to come in. Which office, and should I go alone?
What if I am arrested and held?
For these offences, a magistrate may allow police detention of up to 4 days first and up to 3 days on a second application [f5]. A lawyer can make representations at that hearing. Ask the officer in writing where you are held so family can tell your lawyer.
Can I get bail?
Yes. These offences are bailable, so bail is a right, and the court or police set the amount and conditions [f6]. A lawyer can ask for terms you can meet and help you arrange a guarantor. Be wary of anyone who promises a result or asks for cash outside the court process.
Where would my case be heard, and what does it cost?
It can start in the Magistrates' or Sessions Court, chosen by the prosecution. The six Sarawak High Court locations are Kuching, Sibu, Miri, Sri Aman, Bintulu and Limbang [f7]. Ask for a fee estimate first. The Legal Aid Department (JBG) lists offices for Sarawak, Sibu and Miri [f8], and may help if your income qualifies [f9].
