Six High Courts, so ask which one applies
Sarawak is not a one-court state. The High Court sits at Kuching, Sibu, Miri, Sri Aman, Bintulu and Limbang [f6].
Which one hears your matter depends on where the case is brought. Your bank letter, police notice or charge sheet should show it. The prosecution decides whether a charge goes to the Magistrates’ Court or the Sessions Court.
The office handling your file may not be the nearest
Police headquarters for Sarawak (IPK) is on Jalan Badruddin in Kuching. District offices (IPD) include Kuching, Sibu, Miri, Bintulu and Limbang [f7].
You may be asked for a statement at whichever office handles your case. Ask the officer for the office, the date and the name to look for. If you are arrested, you can consult a lawyer of your choice [f4].
The law is federal, and so is the commercial crime department
The same federal law applies in every Sarawak town. The Public Prosecutor may order a freeze [f1], and that order lapses if you are not charged within 18 months [f2].
Penal Code sections 424A to 424C cover holding, handing over or using an account without a lawful purpose [f3]. The commercial crime department, JSJK, is national [f8], so a Sarawak file may be handled by an officer you never meet in person. See understanding account freezes.
Finding a lawyer when towns are far apart
Distances in Sarawak are long, and the lawyer nearest you may not be in the town where your case is handled. If you are considering legal representation, request independent lawyer contact on WhatsApp with a brief, general message and no documents.
Ask whether the lawyer appears in the Sarawak courts and in which town. Our page on finding legal help lists what else to ask. For a local view, see Kuching, Miri or Sibu.
Legal aid offices
If cost worries you, the Legal Aid Department (JBG) lists offices for Sarawak, Sibu and Miri [f9]. Whether you qualify is for JBG to decide.
You can also ask the Advocates Association of Sarawak what help it can point you to.
Before you ask for help
Enter your account or phone number on PDRM’s Semak Mule portal to see if it has been flagged [f5]. Then keep every bank letter, SMS and screenshot in one place.
Do not move money or open new accounts to get around the freeze. If you cannot tell which power froze your account, a lawyer can help you find out.
