Which court hears a frozen-account case in Sabah?

A frozen or mule account case in Sabah goes through the Sabah courts. The High Court here is the High Court in Sabah and Sarawak, seated in Kota Kinabalu.

It is a separate court from the High Court of Malaya, which serves the Peninsula. A criminal charge is heard first in the Sessions Court or Magistrates’ Court, usually in the district that opened the police file.

Why is representation different in Sabah?

Sabah has its own professional body, the Sabah Law Society, separate from the Malaysian Bar.

For a case heard in Sabah, ask any lawyer whether they appear in the Sabah courts. What a lawyer does for you is the same as anywhere else; see what a lawyer can do.

Does the freeze law change because Sabah is in East Malaysia?

No. The freeze powers are federal law. Under AMLA 2001, an enforcement agency can freeze for up to 90 days, and the Public Prosecutor may order a freeze on accounts suspected of holding proceeds of unlawful activity [f1].

Under the 2024 amendments, a police officer of Sergeant rank or above can also freeze an account without a court order [f2]. Penal Code sections 424A to 424C punish mule-account conduct the same way across Malaysia [f3]. For what these terms mean, see mule account meaning.

Who investigates mule accounts in Sabah?

The national Commercial Crime Investigation Department (JSJK/CCID) at Bukit Aman handles these cases. The Sabah police contingent (IPK) and the district police HQ (IPD) are the local offices. Nationally, it comes under the Commercial Crime Investigation Department (CCID) at Bukit Aman.

If you know which district opened your file, an advocate can find it faster and see what stage it is at.

If cost worries you, there are two places to ask. The Legal Aid Department (Jabatan Bantuan Guaman) Sabah office may give help at low or no cost if your income qualifies [f5].

You can also ask the Sabah Law Society what help it offers. Either way, you keep your right to a lawyer of your choice under Article 5(3) of the Federal Constitution [f4].

What should I do first if my account is frozen in Sabah?

Keep every bank letter, SMS and screenshot in one place. Do not move money or open new accounts to get around the freeze.

Labuan comes under the same High Court in Sabah and Sarawak, so the same courts and federal law apply there. If you cannot tell which power froze your account, an advocate can find out from the bank and police and tell you how to respond.

Where do Sabah cases start, and who investigates?

The High Court has locations in Kota Kinabalu, Sandakan and Tawau [f6]. The Sabah state courts are listed at Kompleks Kehakiman Kota Kinabalu, No.1 Jalan Kebajikan, 88300 Kota Kinabalu [f7]. Sessions and Magistrate’s courts hear most criminal cases first, and the prosecution decides which.

Police work runs from the state headquarters (IPK Sabah) in Kota Kinabalu, with district headquarters (IPD) including Kota Kinabalu, Penampang, Sandakan, Tawau and Labuan [f8]. If you are called to give a statement, note the officer’s name, the station and the reference number before you go.

A press report says Sabah police recorded 7,264 cases, with losses over RM576.7 million, from January 2023 to August 2025 [f11]. That is background only and says nothing about your own case.

The Legal Aid Department has a Sabah branch [f9]. The Sabah Law Society runs a Legal Aid Clinic at Menara MAA, Lorong Api-Api 1, Kota Kinabalu [f10].
