A checklist for a frozen bank account in Sabah

A frozen account is frightening, but a short checklist helps. The freeze law is federal, so it is the same in Sabah as anywhere in Malaysia.

What is local is which court hears any dispute and which lawyers can act. Work through the steps below in order.

For an overview, see what a lawyer can do.

Step 1: Do not move money around

Leave the remaining balance where it is. Do not transfer it to a relative or a second account.

After a freeze, moving money can look like hiding it, whatever your reason. Leaving the account alone is safer while you sort out the rest.

Step 2: Find out who froze the account

Under AMLA section 50(1), the Public Prosecutor may order a freeze [f1]. A police officer of Sergeant rank or above can also freeze an account under CPC section 116D, without a court order [f4].

Ask the bank in writing for the freeze reference and the authority that issued it. The answer decides where your first request goes.

Step 3: Gather documents and a timeline

Collect the freeze notice, all letters, recent statements and a short written timeline of events. Add proof of your monthly costs, such as rent, bills and dependants.

These papers let a Sabah advocate assess your case quickly. They also become the evidence for any request to release money.

Step 4: Check yourself on Semak Mule

Check your account and phone number on the PDRM Semak Mule portal, which flags suspected mule accounts [f5]. A flag means you may face a mule allegation as well as the freeze, which changes the plan.

If so, read mule account lawyer for Sabah so both problems are handled together.

Step 5: Ask for money to be released for living costs

If the freeze leaves you short for daily life, AMLA section 44A lets you apply to vary it and release funds for reasonable living or business expenses [f3]. You apply in writing to the agency that froze the account, and a more senior officer decides.

It is not automatic. Clear proof of your real needs makes the request stronger, and keep the 18-month AMLA limit in mind while you plan [f2].

Step 6: Choose a lawyer who appears in the Sabah courts

Sabah has its own professional body, the Sabah Law Society, separate from the Malaysian Bar.

If your case goes to court, it is heard in the Sabah courts, under the High Court in Sabah and Sarawak at Kota Kinabalu. For example, a CPC section 116D police freeze is varied by applying to the Sessions Court.

A lawyer who appears in those courts can deal with the investigating officers. They can also write the release request to the agency for you. For background, see understanding account freezes.

Where to take the paperwork in Sabah

Start with the bank letter, which should say which agency or order froze the account. If a police officer ordered it, the district headquarters that opened the file is your contact. Sabah’s list includes Kota Kinabalu, Penampang, Sandakan, Tawau and Labuan [f7].

A written release request under section 44A goes to the agency, not to a court, so it can be sent from a town far from Kota Kinabalu. A police freeze is varied at the Sessions Court instead, and the High Court sits in Kota Kinabalu, Sandakan or Tawau [f6].

If cost is a worry, the Sabah Law Society runs a Legal Aid Clinic in Kota Kinabalu [f9], and the Legal Aid Department has a Sabah office [f8].

My Sabah account is frozen. What should I do first?

Leave the money where it is. Moving the balance to another account can look like hiding it. Then ask your bank in writing for the freeze reference and which authority ordered it.

Which court and lawyers handle a Sabah freeze?

The freeze may come from the Public Prosecutor under AMLA section 50(1), or from the police [f1]. Any court step in Sabah goes through the Sabah courts, under the High Court in Sabah and Sarawak at Kota Kinabalu, which is separate from the High Court in Malaya. Sabah lawyers belong to the Sabah Law Society, not the Malaysian Bar.

Should I check Semak Mule myself?

Yes. The PDRM Semak Mule portal shows whether your account or phone number is flagged as a suspected mule [f5]. If it is, you may face a mule allegation as well as the freeze. That changes what your advocate deals with first.

Can I get money released for living costs in Sabah?

Sometimes. Under AMLA section 44A you can apply to vary a freeze and release funds for reasonable living or business expenses [f3]. You apply in writing to the agency that froze the account, and a more senior officer decides. Proof of your rent, bills and dependants makes the request stronger.

How long can my Sabah account stay frozen?

An AMLA order lapses if you are not charged within 18 months [f2]. A police freeze under CPC section 116D also lapses after 18 months without a charge [f4]. Your advocate tracks the date so a lapsed freeze does not keep the account locked.

Do I need to travel to Kota Kinabalu to ask about a freeze?

Not to get a first view. Describe what the bank letter says by WhatsApp and ask for a referral to an independent law firm. Ask whether the lawyer appears in the court nearest you, since the High Court sits in three Sabah towns [f6].
