What is AMLA?

AMLA is the Anti-Money Laundering, Anti-Terrorism Financing and Proceeds of Unlawful Activities Act 2001. [f1] It is Malaysia’s main law for stopping money from crime moving through banks.

It lets the authorities freeze, investigate and seize money linked to crime. If your account was frozen and someone mentioned AMLA, this is the law they used.

What does AMLA cover?

AMLA deals with three things: money laundering, terrorism financing and the use of money made from crime.

The law lists “predicate offences” in its Second Schedule. [f5] A predicate offence is the original crime that produced the money. The list runs from fraud and scams to drug trafficking, corruption, tax evasion and organised crime.

One transaction linked to any one of these crimes is enough for AMLA to apply. That is why people who did nothing wrong can still find their account frozen. Their account received or passed on money from someone else’s crime.

How does an AMLA freeze work?

Under Section 50, the Public Prosecutor can order any bank to freeze an account suspected of holding money from crime. [f2] This is one legal basis for account freezes in Malaysia. Enforcement agencies can also freeze under Section 44, for up to 90 days unless you are charged.

No court hearing is needed before a Section 50 freeze takes effect. Your bank receives the order and must obey it at once. You may find out only when a payment or withdrawal fails.

The freeze covers all the money in the account. You cannot withdraw, transfer or receive money until the freeze is lifted, varied or runs out.

The 18-month limit

Section 52A sets an 18-month limit on a Section 50 order or seizure. [f3] If you are not charged and no prosecution starts within that time, the order lapses.

The Court of Appeal enforced this kind of limit in Lim Hui Jin v CIMB Bank (2018), when the limit was 12 months, and ordered the money returned with interest.

Section 52A has no court extension: the order lapses at 18 months unless the person has been charged or a prosecution has started. Separately, the Public Prosecutor can apply to the High Court for forfeiture before the 18 months expire. Our freeze duration guide explains the time limits in more detail.

Can you get money for living expenses?

Section 44A lets a person whose account is frozen ask for money to be released for basic living costs. [f4] You apply in writing to the enforcement agency that froze the account under section 44, and a more senior officer decides. That covers rent or home loan payments, food, school fees, medical bills and other basic needs.

The application is made in writing to the agency that froze the account. It should show your monthly expenses, prove you have no other money to use, and state the exact amount you need.

A lawyer can prepare this application for you. A request that is specific and backed by documents is easier for the officer to assess.

Who enforces AMLA?

Several agencies have enforcement powers under AMLA, and each handles different offences. [f6]

  • Bank Negara Malaysia (BNM) supervises banks and handles compliance failures.
  • The Royal Malaysia Police (PDRM) investigates money laundering tied to ordinary crime, including scams and mule accounts.
  • The Malaysian Anti-Corruption Commission (MACC) handles money laundering linked to corruption.
  • Royal Malaysian Customs investigates trade-based money laundering and customs offences.
  • The Immigration Department handles money from human trafficking.
  • The Labuan Financial Services Authority covers offshore financial activity.

The agency involved decides where and how you respond. Your bank may be able to tell you which authority issued the freeze, and a lawyer can then advise you on the next step.

How AMLA works with the mule account laws

AMLA works alongside Penal Code sections 424A, 424B and 424C, which were introduced in 2024. AMLA gives the power to freeze and investigate. The Penal Code sections make mule account activity a crime in itself.

If your case involves both AMLA and a 424 section, the authorities are looking at the money trail and at your part in it. The mule account defence guide explains how the two laws interact and what defences exist.

What should you do now?

Ask your bank for the legal basis. Get the reference number, the AMLA section quoted and the name of the authority that issued the order. Write it all down.

Do not move money through another account. AMLA treats dealing with money from crime as a separate offence, and moving money around a freeze can look like that.

Speak to a lawyer who handles AMLA and frozen account cases. A lawyer can find out which agency is leading the investigation and prepare a Section 44A application for living expenses if you need one. They can also advise you before any interview and attend hearings.

Gather proof of where your money came from. Collect bank statements, tax records and employment documents. The evidence preparation guide explains what to gather and how to organise it.

What is AMLA in simple terms?

AMLA is Malaysia's main law against money laundering, terrorism financing and the use of money made from crime. It lets the authorities freeze bank accounts, look into suspicious transactions and seize assets linked to crime.

Why was my account frozen under AMLA?

The authorities suspect your account holds money linked to a "predicate offence", meaning any of the crimes listed in the law. That does not mean you are accused of the crime yourself. The freeze keeps the money in place while they investigate.

How long can AMLA keep my account frozen?

A section 44 freeze by an enforcement agency lasts up to 90 days unless you are charged. A section 50 order lapses after 18 months if you are not charged (Section 52A). Separately, the Public Prosecutor can apply to the High Court for forfeiture before the 18 months expire.

Can I get money for living expenses during an AMLA freeze?

Section 44A lets you apply to vary the freeze so that money is released for basic needs such as rent, food and your children's schooling. You apply in writing to the enforcement agency that froze the account under section 44, and a more senior officer decides. A lawyer can prepare and file this application for you.

What is a predicate offence under AMLA?

It is the original crime that produced the money. AMLA lists them in its Second Schedule, including fraud, drug trafficking, corruption and tax evasion.

Which agencies enforce AMLA?

Bank Negara Malaysia (BNM), the Royal Malaysia Police (PDRM), the Malaysian Anti-Corruption Commission (MACC), Royal Malaysian Customs, the Immigration Department and the Labuan Financial Services Authority. Which one handles your case depends on the type of offence.
