What is an appeal?

An appeal asks a higher court to check a decision made by a lower court. It is not a second trial. Witnesses are usually not called again.

Instead, the higher court reads the record of the case and decides whether the lower court got it wrong.

You can appeal against the conviction, the sentence, or both. Which one fits your case is not always obvious, and that choice comes first.

How long do you have to file an appeal?

Not long. A notice of appeal must be filed within a limited time after the decision.

If you miss that time, you may lose the right to challenge the decision at all. Waiting to see how you feel, or hoping things sort themselves out, can cost you the appeal.

Article 5(3) of the Federal Constitution gives you the right to consult and be defended by a lawyer of your choice [f1]. Use that right as soon as a decision goes against you, not weeks later.

Appealing a conviction

If you believe you were wrongly convicted, you can ask the higher court to find that the lower court was wrong in law or went against the evidence.

This matters in mule-account cases, because some account holders were tricked into giving access. Police detected 46,048 mule accounts in 2023 and 50,295 in 2024 [f4], and a conviction does not always mean the person knew what was going on.

The penalties are heavy. Section 424C, the most serious of these offences, carries up to ten years in jail [f2], so a wrong conviction is worth challenging.

Appealing a sentence

Sometimes you accept the conviction, but the sentence feels too harsh for what you actually did. Then the appeal can be about the sentence alone.

When sentencing, the court can look at whether you were tricked, how involved you were, and whether you have a record. A s424B charge, for example, carries a fine of RM10,000 to RM100,000, or one to seven years in jail, or both [f3]. That is a wide range, so the sentence can be argued.

A lawyer can check whether your sentence sits at the harsh end without good reason, and whether an appeal has a real chance.

Does an appeal pause the sentence?

Not automatically. Whether you can ask for a stay of the sentence, or for bail while the appeal is waiting, depends on your case and the court.

Do not guess at this. It affects your freedom and your money while the appeal is pending, and these applications may also have time limits.

Ask a lawyer about it at the same time as the appeal itself.

What to do after a decision goes against you

Do not sign anything that accepts the outcome as final. Keep every document you were given in court.

Write down what happened and what you disagree with while you still remember clearly. This helps a lawyer see quickly whether you have grounds to appeal.

An appeal does not retell your whole story. It points to specific mistakes in law or findings that go against the evidence. A lawyer can tell you plainly whether your concerns fit, or whether another route suits you better.

If cost worries you, say so when you ask for help.

If you send us the decision date, the charge and the sentence by WhatsApp, we can refer you to a lawyer who can check your deadline and your grounds.

What does an appeal actually challenge?

An appeal asks a higher court to check a decision made by a lower court. You can appeal the conviction, the sentence, or both. Witnesses are not heard again: the higher court reads the record and decides whether the decision was wrong in law or plainly against the evidence.

Is there a deadline to file an appeal?

Yes, and it is short. A notice of appeal must be filed within a limited time after the decision, and missing it can end your chance to challenge it. The exact period depends on the court and the order, so speak to a lawyer as soon as a decision goes against you.

Can I appeal only the sentence?

Yes. If you accept the conviction but the sentence feels too harsh, the appeal can be about the sentence alone. A court can look at your role, whether you were tricked, and your record. A lawyer can tell you whether a sentence appeal has a real basis in your case.

Does filing an appeal pause the sentence?

Not automatically. Whether you can ask for a stay of the sentence, or for bail while the appeal is waiting, depends on your case and the court. Raise this with a lawyer straight away, because it affects your freedom and money while the appeal is pending.
