What the investigation paper is

The investigation paper, or kertas siasatan, is the police file on a suspected offence. The police report, statements and evidence are all kept in it.

It is not a verdict and it is not a charge. It is the material that later decisions are based on, so what goes into it now shapes what happens to you next.

Who builds it

The Commercial Crime Investigation Department (CCID, or JSJK in Malay) investigates mule account cases [f1]. One investigating officer is in charge of the file.

That officer takes statements, asks banks for records and collects other evidence. The file reflects what the officer collects, which is why your side needs to reach that officer clearly.

What goes into it

The file can hold the first police report, statements from the people involved, bank records tracing the money, and other evidence.

The offence being investigated decides what the officer looks for. Take Penal Code s424A, which covers controlling someone else’s account without lawful authority. It carries a fine of RM5,000 to RM50,000, or 6 months to 5 years in jail, or both [f3].

A file that holds only one side may be hard to correct later. That is why giving your side clearly, early, is worth the effort.

How your statement fits in

What you tell the investigating officer goes into the file. It can be used when the file is reviewed, so treat it as a formal record, not a chat.

Article 5(3) of the Federal Constitution gives you the right to consult a lawyer of your choice [f2]. Use it before you give your statement, and bring your documents so your account is accurate and complete.

A rushed statement can cause confusion that is hard to undo. A lawyer can go through your documents with you and help you prepare what to say.

Where the file goes next

When the officer finishes, the file goes to a Deputy Public Prosecutor. The prosecutor reads the evidence and decides whether it supports a charge.

So the file feeds the charging decision; it is not the decision. Police detected 46,048 mule accounts in 2023 and 50,295 in 2024 [f4], but a file does not always lead to a charge.

A file is not a conclusion

Having a file opened on you does not mean the outcome is fixed. The file is only as strong as what is in it, and what is missing counts too.

A file built only from one side, without your explanation and documents, is incomplete. Your account, given clearly during the investigation, becomes part of the same record.

The prosecutor does not have to charge just because a file exists. Gaps, weak links and a believable innocent explanation all count when the evidence is weighed.

What you can do at this stage

Cooperate, keep your own copies of documents, and get advice before you give a statement. This is not being difficult; it makes sure the record is accurate.

If you are unsure what to say or what to hand over, speak to a lawyer first. A short talk before you act can prevent a mistake that is hard to fix later.

What exactly is an investigation paper?

It is the police file for a suspected offence. It usually holds the police report, statements, bank records and other evidence. The investigating officer builds it, and a prosecutor later uses it to decide whether to charge.

Can I see my own investigation paper?

Not automatically. It is a police working file, so what you can get, and when, depends on the stage of the case. A lawyer can tell you what can be asked for and how.

Does my statement go into the investigation paper?

Yes. What you tell the investigating officer goes into the file and can be used later. Under Article 5(3) you may consult a lawyer before you give it. The rules on how a statement can be used later are technical, so get advice first and bring your documents.

What happens to the investigation paper after it is done?

The officer sends it to a Deputy Public Prosecutor. The prosecutor checks the evidence and decides to charge, ask for more investigation, or take no further action. The file feeds that decision; it is not the decision.
