Steady your mind first

Remand is hard, but it is part of an investigation, not a verdict. Hold on to that.

Fear grows when you do not know what comes next. Remind yourself that remand has a time limit and that a process is moving. For these offences a Magistrate can allow up to 4 days at first and up to 3 more later.

You do not need to solve the whole case in your head. Your job is to stay steady, one hour at a time.

Look after your health

Rest when you can, eat what is given, and keep a small routine. Neglecting your body and mind makes everything harder.

If you have a medical condition or take regular medicine, tell the officers clearly. Do not stay quiet out of fear.

Ask your family to tell your lawyer about any health issue too, so it is on record and can be followed up.

Hold on to your right to a lawyer

Article 5(3) of the Federal Constitution gives you the right to consult and be defended by a lawyer of your choice [f1]. During remand, this right is your main protection.

Ask to use it, and let your family arrange it. A lawyer gives you accurate information when everyone around you is passing on rumours.

If cost worries you, the Legal Aid Department may give help at low or no cost to people whose income qualifies [f2]. Having little money does not have to mean having no advice.

Leave big decisions until you get advice

You may be questioned during remand as part of the investigation by the Commercial Crime Investigation Department (CCID) [f3]. This is not the time to make big decisions alone.

Do not act on what another detainee tells you. Their tips may be well meant but can be wrong, and they have not seen your file.

Answer honestly, but do not guess or make up details to fill a silence. Careful, true answers protect you better than rushed ones.

Let your family organise support

Your family can arrange a lawyer, collect documents that support your side, and keep track of dates and hearings. Knowing this is being handled outside takes real pressure off you.

Ask them to put their questions through your lawyer instead of acting in panic.

Police detected 46,048 mule accounts in 2023 and 50,295 in 2024 [f4], so your family is not the first to face this.

Keep a list of questions for your lawyer

Turn each worry into a question for your lawyer. A short list gives the fear somewhere to go.

Useful questions include how long this stage may last, what happens at the next hearing, and what your family should bring. Ask about your welfare too: medicine, family contact and how to raise a health need.

Also note what you were asked during questioning: the topics, who was there and the dates. This helps your lawyer see what the investigation is focused on.

One day at a time

You do not have to carry the whole thing at once. Think about today, and the next small thing you can do.

If someone you love is on remand right now, send us a WhatsApp message. We can refer your family to a lawyer who can see them and explain the next step.

How do I stay calm during remand?

Focus on what you can control: your routine, your health and how you answer. Remand is part of an investigation, not a conviction, and it has a time limit. Write your worries down as questions for your lawyer instead of turning them over all night.

Can I see or speak to a lawyer while remanded?

Yes, the Federal Constitution gives you the right to consult and be defended by a lawyer of your choice. Ask to use it and let your family arrange it. If money is a problem, legal aid may be available if you qualify.

What about my medicine and health needs?

Tell the officers clearly about any medical condition or regular medicine. Ask your family to tell your lawyer as well, so it is on record. Do not stay quiet about a real health need.

How can my family help while I am remanded?

They can find a lawyer, collect documents that support your side, and keep track of dates. Ask them to put their questions through your lawyer and not act on rumours.
