Why source of funds is the heart of it

An order under AMLA 2001 s50(1) is made by the Public Prosecutor where money is suspected to be linked to unlawful activity [f1]. The direct answer to that suspicion is to show where your money honestly came from.

If every ringgit in the account can be traced to salary, sales or family support, the suspicion loses its footing. This work is tedious, but it is the most useful thing you can do yourself.

Step 1: List every deposit

Take your bank statements for the relevant period and list each credit into the account. Note the date, the amount and who sent it.

Do not skip small entries. A complete list is the base for everything else.

Step 2: Match each deposit to a source

Next to each entry, write what the money was: salary, a customer payment, a friend repaying a loan, a transfer from a parent.

This shows which deposits are easy to prove and which need more paper. Work line by line.

Round amounts and repeated transfers from senders you do not know can draw questions. Spot them early. If a deposit surprises even you, look into it before anyone else does.

Step 3: Collect the supporting document

For each source, get the record that proves it. Use payslips and employer letters for salary, invoices and receipts for sales, and bank transfer records for money from family or friends.

The aim is a paper trail linking one deposit to one honest source. Police detected 46,048 mule accounts in 2023 and 50,295 in 2024 [f4], so a clear paper trail helps your case stand out from the rest.

Keep the documents in the same order as your list and label them by date and amount. A tidy file works far better than a shoebox of loose receipts.

Step 4: Explain the gaps honestly

Some records may be missing. Banks can supply older statements, employers can reissue payslips, and platforms keep sales histories.

If a document truly cannot be found, write a short, honest note on what the deposit was and why you have no paper. A frank explanation beats a silent gap.

Step 5: Use it to ask for money to be released

Good source evidence does more than explain. It can support a written application under AMLA 2001 s44A to the agency that froze the account, asking to vary the freeze and release money for reasonable living or business expenses [f2].

An AMLA s44 freeze ends after 90 days if you are not charged, and a seizure order under s52A lapses after 18 months if you are not charged or no prosecution is started [f3]. A lawyer can prepare the application and your explanation from the same file.

Keep adding records as they arrive, and give your lawyer a copy rather than the originals. If you are considering legal representation, request independent lawyer contact on WhatsApp with a brief, general message and no documents.

Why does source of funds matter so much?

A freeze under the Anti-Money Laundering Act (AMLA) is aimed at money suspected to come from unlawful activity. Showing that your deposits came from honest sources, such as salary, sales or family transfers, answers that suspicion directly. It also supports any request to release money for living or business costs.

What counts as good source evidence?

Documents that confirm where each deposit came from. Payslips and employer letters explain salary, invoices and receipts explain sales, and bank transfer records explain money from family or friends. The clearer the link between one deposit and one honest source, the easier it is to follow.

What if I do not have every document?

Gather what you can and be honest about the gaps. Banks can supply older statements, employers can reissue payslips, and platforms keep sales histories. If a record is truly missing, a short note saying what the deposit was and why you have no paper is better than silence.

Can proving my source help release some money?

It can support a written application to the enforcement agency under AMLA s44A to vary a section 44 freeze, so you can pay reasonable living or business expenses. The clearer your evidence, the stronger the request. A lawyer can prepare the application, attach the right documents and explain the costs you need covered.
