Why does a genuine fundraiser get flagged?

You opened an account to collect money for a cause, such as medical bills, disaster relief or a community project. Many small amounts came in, some from people you have never met. That is exactly the pattern monitoring systems are built to spot. [f1]

Under AMLA 2001, an account suspected of holding criminal money can be frozen. Since the 2024 amendments, police can also freeze an account at once without a court order. [f2] The trigger can be the number of transfers and senders, not an accusation against you.

To a system scanning transactions, a real fundraiser and a mule account can look the same. The difference is in the records behind the collection, and those are what you need to show now.

Could one donor’s bad transfer freeze everything?

Yes, it can. If one donor’s money is later traced to a scam and the victim reports it, the freeze can cover your whole account. [f4]

You cannot check where every donor’s money came from, and nobody expects you to. What you can do is keep the fundraiser’s purpose public and consistent, so a review can quickly see what the account is for.

What should you record right now?

Save the original appeal, wherever you shared it: social media, a chat group or a community notice board. It shows the cause and planned use of the money before any flag appeared.

Keep a donor list if you have one, even an informal spreadsheet of names, amounts and dates. Keep any thank-you messages or receipts you sent.

Record how the money was spent or will be spent, such as a hospital bill, a supplier invoice or receipts for relief items. A clear line from donation to purpose is the strongest thing you can show an investigator.

How can you check your account’s status?

You can check whether your account is formally flagged on PDRM’s Semak Mule portal. [f3] This tells you whether you face a mule flag or a different hold from your bank.

If your account is flagged, the records above are the basis for asking for a review, either with the bank directly or through a lawyer.

Can you use the money while the account is under review?

If an enforcement agency froze your account under AMLA Section 44, not just flagged, Section 44A lets you apply in writing to the enforcement agency to release money for reasonable expenses or for debts you owed in good faith before the freeze. [f5] This matters when someone is waiting for the money, such as a family facing a hospital bill.

The freeze has a limit. A Section 44 freeze lasts up to 90 days unless someone is charged. Under Section 52A, a later seizure or Section 50 order lapses if no one is charged within 18 months. [f6]

How do you protect the cause in the meantime?

Tell your donors in general terms what is happening, without alarming them. If you explain clearly, donors may understand that a review is a process, not an accusation.

Do not move donated money into a personal or other account to get around the flag. That muddies your records and makes an innocent situation harder to explain.

How can a lawyer help clear the flag?

A lawyer can put your donor records, appeal posts and spending records into one clear file. The lawyer can ask your bank for the exact reason for the flag. If needed, the lawyer can also make a written Section 44A application to the agency to release money for reasonable expenses or good-faith debts. [f5]

Sorting out the flag matters for both your access to the money and the public trust behind your fundraiser.

Why would a charity collection account get flagged at all?

Banks and the authorities watch for accounts that receive many small transfers from unrelated people in a short time. That is also how a mule account collecting scam money looks. [f1] A genuine fundraiser can set off the same checks because of the pattern alone.

Does it matter that every donor gave willingly?

Yes, for your defence. But the bank's system cannot see why people gave, only how many transfers came in and from whom. Records showing donors gave knowingly for a stated cause are what show the account is a real fundraiser.

Could one bad transfer freeze the whole donation account?

It can. If one donor's money is later traced to a scam and the victim reports it, the freeze can cover your whole account, not just that transfer. [f4] That is why a public, stated purpose from day one matters.

How do we prove the donations were genuine?

Keep the appeal post, the stated cause and target, a donor list if you have one, receipts or thank-you messages, and records of how the money was spent. A public trail linking the collection to a real cause is your strongest evidence.

Can we use the donated money while this is being resolved?

If an enforcement agency froze the account under AMLA Section 44, you can apply to it in writing under Section 44A to release money for reasonable expenses or for debts you owed in good faith before the freeze, such as a supplier you had already committed to. [f5] The agency decides, and clear records of what the money was raised for will help.

How long could our account stay flagged or frozen?

An AMLA freeze under Section 44 lasts up to 90 days unless someone is charged. A later seizure or Section 50 order lapses under Section 52A if no one is charged within 18 months. [f6] A police freeze under CPC Section 116D lapses after 18 months if no prosecution starts. Any of them can end sooner once the authorities are satisfied.
