Criminal vs Civil Remedies for Freezes
You have legal options on both the criminal and civil side to get your frozen account released.

What are criminal and civil remedies?
When your bank account is frozen in Malaysia, two separate paths can apply. The criminal path is the police investigation and any charge that follows. The other path is the applications you can make yourself, whatever the police or prosecution decide.
You do not need to wait for the investigation to finish before applying for relief. These remedies exist to protect your rights while the criminal process runs. [f5]
How does the criminal path work?
The police lead the investigation, often through JSJK, the commercial crime department. Under CPC Section 116D, police can freeze your account during an investigation without a court order. [f1]
The investigation decides whether there is enough evidence to charge you under the Penal Code, for example under Section 424A, Section 424B or Section 424C. The police gather evidence, record statements and send their findings to a Deputy Public Prosecutor to decide.
At this stage you cooperate and use your rights during the investigation. Mostly you respond to police requests and wait.
What can you do yourself?
These are steps you start. The most common is asking for the freeze to be varied or lifted, for example to release money for living costs.
For an AMLA s44 freeze, Section 44A lets you make a written application to the enforcement agency to vary it. [f2] For a police freeze under CPC s116D, the variation is decided by a Sessions Court.
Another option is judicial review, where you ask the court to check whether the freeze was lawful and fair. Article 13 of the Federal Constitution protects your right to property, and any loss of property must follow the law. [f5]
A civil claim for a wrongful freeze is also possible if the freeze had no proper legal basis. Whether it fits depends on the facts, and a lawyer can tell you.
How do the standards of proof differ?
In a criminal case, the prosecution must prove guilt beyond reasonable doubt. [f3] This is the highest standard in law: the court must be close to certain before convicting.
In a civil case, the standard is the balance of probabilities. [f4] You only need to show your version is more likely true than not. That lower bar applies to a civil claim about the money, which is judged separately from the criminal case.
So you may have a route to relief while the criminal process, with its higher bar, takes its course.
Can both paths run at the same time?
Yes. The criminal and civil sides are independent. Applying to vary a freeze (see court-ordered freezes and AMLA Section 44A) does not interfere with the police investigation.
You can apply for relief while the investigation is still going, especially when the freeze leaves you unable to pay rent, bills or support your family. A lawyer who handles frozen account cases can prepare the application and advise on timing.
When deciding, the court or agency may consider whether the investigation has found any evidence against you.
What happens if the criminal case is dropped?
If the police or prosecution decide not to charge you, the freeze should be lifted. Getting your account unfrozen means confirming the decision with the Investigating Officer and making sure the bank receives the release instruction.
If the freeze stays after the case is dropped, you can apply to lift it: in writing to the enforcement agency for an AMLA s44 freeze, or to the Sessions Court for a police s116D freeze. A No Further Action (NFA) letter supports that application.
Your rights as an account holder include having the freeze removed once its legal basis is gone.
Which path should you choose?
It depends on your situation. If the freeze is causing hardship now, an application to vary it may be the fastest relief. If the investigation has stalled or is dragging on, an application to vary or lift the freeze can push things forward.
Often the answer is both. A lawyer can handle your criminal defence and, at the same time, apply to ease the financial pressure.
A lawyer can look at the facts, including the type of freeze and the stage of the investigation, and tell you which step to take first.

What is the difference between criminal and civil remedies for a frozen account?
The criminal side is run by the police and prosecution: they investigate and decide whether to charge. The other side is what you start yourself, such as asking for the freeze to be varied or lifted. Both can run at the same time.
Can I apply for relief while a criminal investigation is ongoing?
Yes. You do not have to wait for the criminal case to end. For an AMLA s44 freeze, you can apply in writing to the enforcement agency under s44A to release money for basic living costs. For a police freeze under CPC s116D, the variation goes to a Sessions Court.
What does 'beyond reasonable doubt' mean for my case?
It is the standard the prosecution must meet to convict you. The court must be close to certain you are guilty. If the prosecution falls short, you are acquitted.
What does 'balance of probabilities' mean in a civil case?
The court decides which version of events is more likely true. It is a lower standard than in a criminal case. In a civil claim about the money, you must show it is more likely than not lawfully yours.
Do I need separate lawyers for criminal and civil matters?
Not always. Some lawyers handle both the criminal defence and the applications to vary a freeze. If your case has both, ask your lawyer whether they cover both or will refer one side to someone else.
How long does each path take?
A criminal investigation can take a long time before a decision to charge or release. An application to vary a freeze can be made while the investigation continues. It may help you get money for basic needs sooner.
