Can a lawyer unfreeze my account?

No lawyer can promise to unfreeze your account, so be careful with anyone who does. A lawyer can use the routes the law provides and argue your case. The decision stays with the agency, the Public Prosecutor or a court. Nothing reverses a freeze just because you ask.

What does a section 44A variation do?

The route people ask about first is a section 44A variation. It does not lift the freeze. It asks for money to be released for reasonable living or business expenses while the freeze stays in place [f1].

You make it as a written application to the enforcement agency that froze the account, backed by proof of your real costs. A more senior officer at the agency decides; it does not go to court. Keep clear records of rent, bills and business costs so the request rests on real numbers.

What about judicial review, or the freeze lapsing?

A second route is judicial review. Here a lawyer asks the court to set aside a freeze that seems unlawful or beyond the officer’s power. It is a legal argument, not a sure way to reverse the freeze.

Time can also matter. An agency freeze under section 44 ends after 90 days if the person is not charged. [f5] A seizure or section 50 order lapses after 18 months without a charge [f2].

A police freeze under section 116D works through a different process, so it matters which type you have [f3]. To vary or revoke a section 116D freeze, the person named applies to the Sessions Court.

Why can no one promise the outcome?

Each route depends on the facts, the evidence and the judgment of a court or agency. Two accounts frozen on similar suspicions can end differently, depending on what the records show.

That is why a careful lawyer explains each route and its risks instead of promising a result. If you are arrested, Article 5(3) says you shall be allowed to consult a lawyer of your choice [f4]. Getting advice early gives your lawyer more time to prepare.

So a lawyer cannot promise my account will be unfrozen?

Correct. No lawyer can promise that. A lawyer can prepare a variation application, write to the investigating officer, and seek judicial review if a freeze looks unlawful [f1]. Whether the account is released depends on the evidence and on the decision of the agency, the Public Prosecutor or a court.

How long can the freeze last before it lapses?

An agency freeze under AMLA section 44 ends after 90 days if the person is not charged. A seizure or section 50 order lapses after 18 months without a charge [f2]. Those limits are set by law; they are not something a lawyer wins for you. A police freeze under section 116D lapses after 18 months without a prosecution, so ask which type of freeze you have.

Can I get some money released while it stays frozen?

That is what a section 44A variation asks for: release of money for reasonable living or business expenses while the freeze stays in place [f1]. You make a written application to the agency, and a more senior officer decides. Keep records of your real expenses so the request rests on actual figures.
