Do I need a lawyer to give a statement?
The law does not require you to bring a lawyer to a police statement. But you can ask to speak to one first, and it can be sensible. If you are arrested, Article 5(3) of the Federal Constitution says you shall be allowed to consult a lawyer of your choice [f1]. There is no general right to have the lawyer sit in during the questioning.
Statements in mule-account cases can be taken by the Commercial Crime Investigation Department (JSJK), at a district police station or at Bukit Aman [f2]. The officer asks how the account was opened, who used it, and where the money came from. Your answers are written down, you sign them, and they go into the investigation file, so read the statement carefully before you sign.
Why advice before the statement helps
Mule-account cases can turn on one question: did you knowingly let someone use your account? Penal Code section 424A covers controlling another person’s account without lawful authority [f3]. A lawyer can explain what the officer’s questions are really trying to establish.
Advice beforehand also helps you sort your documents, get your dates right, and avoid careless answers given out of fear. Some account holders are victims themselves, tricked into sharing card details or online banking access.
When you should call a lawyer
Call a lawyer if you have been arrested, if large sums are involved, or if you are not sure how your account was used. Even a short consultation gives you a clearer picture before you sit down with the investigators.
Cooperating and being prepared go together. You can attend, answer honestly, and still have a lawyer explain your rights and how the process works.
How to prepare for the statement
Before the session, write a short timeline: when the account was opened, when you noticed something wrong, and when you reported it to the bank or police. Notes help you stay accurate when you are nervous.
Bring your phone if related messages or call records are on it, because the officer may ask how you were contacted. If you are unsure of a date or amount, say you need to check your records rather than guess.

Can I refuse to answer questions?
You must attend when lawfully called, and you must state the truth. You may refuse a question only if the answer could expose you to a criminal charge, a penalty or forfeiture. If you do not know something, say so rather than guess. A lawyer can explain beforehand which questions that might cover, and how to answer honestly without harming your own position.
Will asking for a lawyer make me look guilty?
No. Asking for legal advice is not an admission. If you are arrested, the Federal Constitution gives you the right to consult a lawyer. A lawyer can help you give a clear, accurate account, which matters especially if you are an account holder caught in a scam.
What if I cannot afford a private lawyer?
Legal aid may be available to eligible people through the National Legal Aid Foundation (YBGK), which covers criminal cases at arrest, remand and bail, or the Legal Aid Department. Check their rules. The Bar Council can also point you to lawyers. Even a short phone consultation before your statement is better than no advice.
