Will your employer find out your account is frozen?

Not automatically. A freeze involves you, your bank and the authorities who ordered it, and no notice goes to your employer [f1]. Work can find out through a practical problem.

The usual problem is a salary account that suddenly stops working. So that is where to focus.

Who is told about a freeze?

Under section 116D, a police officer can order your bank to freeze the account during an investigation [f1]. The order is aimed at the account. It is not sent to your employer or anyone else.

The order itself is not sent to your workplace.

Why it can still come up at work

The risk is money, not paperwork. If your salary is paid into the frozen account, the pay can get stuck there, and that is what tends to raise questions.

You may then need to give payroll another account of your own. HR may ask why your bank details changed, but you decide how much to say.

What to tell HR, and how to get money for daily costs

For future salary, paying into another account of your own is a practical step. If HR asks, saying it is a banking issue is true and keeps the details private. You do not have to explain an investigation to your employer.

If the freeze is under AMLA, you can apply under section 44A to release money for reasonable living and business costs [f2]. That application is made in writing to the agency that froze the account. A police freeze under section 116D is different: you apply to the Sessions Court to change or lift it [f1].

What to do next

If you have another account of your own, ask payroll to use it. Keep a copy of every message or letter from the bank.

If the freeze is making daily costs hard, prepare the right application to release funds [f2]. Before you give any detailed statement about the matter, use your right under Article 5(3) to speak to a lawyer of your choice [f3]. A lawyer can tell you which law froze the account and prepare the application for you.

Decide in advance what you will say if work asks. Keep it short and true. The main risk is cash, so sorting out your salary account matters most [f1].

Does the bank tell my employer about a freeze?

No. The authorities order the freeze and your bank carries it out; no notice goes to your employer [f1]. Work can find out if your salary account stops working. If your salary goes to a different account, work may never know.

My salary goes into the frozen account. What now?

Pay that lands in a frozen account can be stuck, so ask payroll to pay future salary into another account in your own name, if you have one. If it is an AMLA section 44 freeze by an enforcement agency, you can apply in writing to the enforcement agency under section 44A to release money for reasonable living costs [f2]. If you want to keep the detail private, tell HR it is a banking issue.

Can I be disciplined at work just for a freeze?

A freeze is a step in an investigation based on suspicion. It is not a charge or a conviction [f1]. Whether work can act depends on your employment terms and the facts, not on the freeze alone. Under Article 5(3) you can speak to a lawyer of your choice before you respond to anything [f3].
