What a frozen account does to a Kajang food stall
A small Kajang stall runs on daily takings. Sales go into one account, and the same account pays for tomorrow’s ingredients, the stall rent and the helpers’ wages.
When that account is frozen, everything stops at once. There is no money for tomorrow’s stock and no cash for wages, and a business that lives day to day cannot wait long.
Every freeze comes from a specific legal power. Under section 50 of the Anti-Money Laundering Act (AMLA), the Public Prosecutor can freeze an account suspected of holding money from crime [f1]. A lawyer’s first job is to find out which power was used on your account.
Getting money released for stock, rent and helpers
A small business can ask for money to keep trading. Section 44A of AMLA lets the account holder apply in writing to the enforcement agency that froze the account under section 44, asking it to change the freeze so reasonable business or living costs can be paid [f3]. A more senior officer decides.
No court is involved. The agency wants evidence, so need alone is not enough.
A lawyer can list your daily supply costs, rent and wages, then ask for exactly what the stall needs to stay open.
How long an AMLA freeze can last
An AMLA freeze cannot last forever. A freeze by an enforcement agency under section 44 lasts up to 90 days unless you are charged, and an order under section 50 lapses after 18 months if you are not charged (section 52A) [f2].
For a small trader, those limits work as a timetable. A lawyer can plan an objection or a release request around the time left on the order, so you know what happens next and when.
Complaining to the bank, Bank Negara and FMOS
Sometimes the bank will not explain anything at all. Start with a written complaint to the branch and keep every reply.
If the branch does not act, call BNMLINK on 1-300-88-5465, Bank Negara’s official channel for complaints about a bank [f4]. Have your written complaint and the bank’s replies ready first.
If an eligible dispute is still unresolved after the bank’s own process, it can go to the Financial Markets Ombudsman Service (FMOS) [f5]. A lawyer can help you take these steps in the right order.
Kajang salary earners: who to contact, and where a case may go
If rent and bills are the worry, the first call is not to a court. Section 44A asks the enforcement agency in writing to release money for living costs, so gather payslips, tenancy papers and bills. A lawyer can send that request for you.
Kajang is a listed police district, so a notice from Kajang police goes to the district office. [f7] Keep the notice, and do not give a statement until you have advice.
If a charge comes, Kajang has a Sessions and Magistrates court, and the High Courts are listed at Shah Alam and Klang. [f6] The Legal Aid Department [f8] and the Bar Council centre in Shah Alam [f9] are the places to ask about fees.

My Kajang stall's account is frozen. Can I still buy ingredients?
Not from the frozen balance, but you can ask for some of it to be released. Section 44A of AMLA lets you apply in writing to the enforcement agency that froze the account under section 44, asking it to release money for reasonable business costs, which can include stock and supplies [f3]. A more senior officer decides. A lawyer can set out your daily purchases and margins so the request shows real trading.
My helpers and stall rent are due this week. What comes first?
Act quickly and keep every record. A lawyer can write to the bank to ask which power froze the account, then prepare a section 44A application covering wages and rent [f3]. For a cash-based food stall, every day without stock costs sales.
Which police office deals with a Kajang account freeze?
If the notice names Kajang, it is the Kajang police district office listed in the PDRM directory. [f7] A freeze by police under section 116D is varied at the Sessions Court. A freeze by an enforcement agency is varied by section 44A, in writing to that agency.
The bank will not explain the freeze. Where do I complain?
How long can this drag on for a small business?
An AMLA freeze has a limit. A freeze by an enforcement agency under section 44 lasts up to 90 days unless you are charged, and an order under section 50 lapses after 18 months if you are not charged (section 52A) [f2]. Knowing the dates lets a lawyer plan a release request or objection before the stall runs out of cash.
