A Perak freeze ends in one of two ways

A frozen account can feel endless, but it has limits. It can end in two ways: the freeze lapses with no charge, or someone is charged and the case goes to court.

Knowing both outcomes early changes how you prepare. You do not have to wait to see which happens, because you can get ready for either.

The freeze laws are federal, so the same two outcomes apply across Perak, in Ipoh, Taiping and Teluk Intan. What is local is the police district and the court.

How the freeze starts

Under AMLA section 50(1), the Public Prosecutor can order a freeze on accounts suspected of holding money from crime. [f3]

A scam victim’s report can start this, if it names an account that received a transfer. The report does not prove guilt, but it starts the investigation.

The investigation in between

Between the freeze and the outcome, investigators look into the account. This is the time to prepare your explanation and your papers.

The Commercial Crime Investigation Department (CCID/JSJK) at Bukit Aman investigates mule account cases. [f5] A lawyer can deal with the investigators and help you respond properly before any decision is made.

Outcome one: the freeze lapses

The first outcome is that the freeze ends with no charge. Under section 52A, an AMLA order lapses if no one is charged within 18 months. [f1]

If the bank has not lifted the block after that, a lawyer can follow up with the bank and the agency. The account holder rights page explains your position.

Outcome two: a charge under the mule offences

The second outcome is a charge. The most serious mule offence is Penal Code section 424C, which covers transactions through an account without a lawful purpose. It carries 3 to 10 years in jail, a fine of RM10,000 to RM150,000, or both. [f2]

Not every case ends in a charge, and being named is not the same as being guilty. A lawyer can tell you which offence, if any, fits the allegation. See section 424C explained and what a lawyer can do for how a defence is built.

A case from anywhere in Perak goes through the Perak courts, and the High Court in Malaya sits in Ipoh.

While you wait, you may be able to get money released for essentials. If an enforcement agency froze the account under AMLA section 44, section 44A lets you apply in writing to that agency for reasonable living or business costs. [f4]

If cost is a worry, the Legal Aid Department (Jabatan Bantuan Guaman) Perak office may help if your income is within its limits. The Perak page covers the rest of the state.

Where Perak police may ask you to go

If police call you in, the notice should name the office. The police directory lists the Perak Contingent Police Headquarters (IPK) in Ipoh and district headquarters (IPD) in places such as Taiping, Kampar, Kuala Kangsar, Manjung and Batu Gajah. [f7]

Ask whether you must attend at the district or at the contingent, and bring your freeze papers. A lawyer can arrange the date with the officer.

Which court a charge would reach is decided by the prosecution. The High Court sits in Ipoh. [f6] For cost, the Legal Aid Department lists a Perak office and a Taiping office. [f8]

How can a frozen account in Perak end?

There are two main ways. Either no one is charged and, for an AMLA order, the freeze lapses at the 18-month limit under section 52A. Or investigators bring a charge and the case goes to the criminal courts. You may not know at the start which way it will go, so a lawyer prepares for both. [f1]

What could I be charged with in a mule case?

The mule offences are in the Penal Code. The most serious, section 424C, covers transactions through an account without a lawful purpose. It carries 3 to 10 years in jail, a fine of RM10,000 to RM150,000, or both. Other sections cover using someone else's account or handing over your own. A lawyer can tell you which, if any, fits the allegation. [f2]

If no one is charged, is the freeze lifted by itself?

An AMLA order lapses once 18 months pass with no charge, under section 52A. If the bank still holds the money after that, a lawyer can write to the bank and the agency to have the block lifted. [f1]

Can I get money released while the case is undecided?

Sometimes. If an enforcement agency froze the account under AMLA section 44, section 44A lets you apply in writing to that agency to release money for reasonable living or business costs. A more senior officer decides, based on your papers. A lawyer can build the request around your real monthly bills. [f4]

Where would Perak police ask me to go?

The police directory lists the Perak contingent headquarters (IPK) in Ipoh and district headquarters (IPD) such as Taiping, Kampar, Kuala Kangsar and Manjung. The notice should name the office, and if it does not, ask before you go. The Commercial Crime Investigation Department at Bukit Aman is the national unit that investigates mule cases. [f7] [f5]
