What does AML/CFT mean?

AML/CFT stands for anti-money-laundering and counter-financing of terrorism. It describes the laws, rules and bank controls meant to stop dirty money and terrorism funding moving through the financial system.

In Malaysia the central law is the Anti-Money Laundering Act 2001, called AMLA. Banks and regulators build their daily checks on top of it.

What is the main law behind it?

The framework is not just policy. It carries real powers over accounts. Under AMLA s50(1), the Public Prosecutor can order a bank not to deal with money suspected to be proceeds of unlawful activity [f1].

That power has limits. Under s52A, a seizure order lapses 18 months after it is made if no one is charged or prosecuted [f2]. So the framework gives a power and also caps how long it lasts.

Why can it reach an ordinary account?

You do not have to be a criminal for an AML/CFT check to touch your account. The framework works on suspicion and on where money flows, so an innocent account can be caught if money linked to a scam passes through it.

Bank Negara Malaysia, the central bank that supervises financial institutions, oversees how banks apply these controls [f3]. If your account is frozen, a lawyer can help you find out which power was used and what the time limit is.

What does AML/CFT stand for?

AML stands for anti-money-laundering. CFT stands for counter-financing of terrorism. Together they describe the laws, rules and controls meant to stop dirty money and terrorism funding moving through the financial system. In Malaysia the central law is the Anti-Money Laundering Act 2001, or AMLA.

How can AML/CFT affect my bank account?

Under s50(1) of AMLA, the Public Prosecutor can order a bank not to deal with money suspected to be proceeds of unlawful activity. That is how an ordinary account can be caught up in an investigation before anyone is charged, if suspect money passed through it.

Is a freeze under this framework permanent?

No. Under AMLA s52A, a seizure order lapses 18 months after it is made if you are not charged. So the framework gives a power and also limits it. A lawyer can explain the timeline for your case.
