What it means
A prima facie case is one that, on its face, would be enough to support a conviction if nobody answers it. The prosecution has put forward evidence on each element of the offence which, taken at its highest, could lead to a finding of guilt.
The key word is “could”. A prima facie case is a threshold the prosecution must cross. It is not a final decision that the accused is guilty.
When does the court decide it?
This is usually decided at the end of the prosecution’s evidence. The court looks at whether each element of the charged offence has been proved.
The section charged decides what those elements are. For making transactions through an account without a lawful purpose under Penal Code s424C, the prosecution must show evidence of that conduct. [f2] The offence carries 3 to 10 years in jail, or a fine of RM10,000 to RM150,000, or both. [f2]
Mule accounts are a large enforcement area: police detected 46,048 mule accounts in 2023 and 50,295 in 2024. [f3] This step still applies to each case on its own.
Why is it not a finding of guilt?
If a prima facie case is made out, the accused is called to enter a defence. If it is not, the accused may be acquitted at that stage. Either way, it is only a threshold, and the court must still be sure of guilt beyond reasonable doubt before it convicts.
This moment shapes the rest of the trial, so careful decisions matter. You have the right to consult and be defended by a lawyer of your choice. [f1] Early advice lets you prepare for this stage instead of facing it unready.

Does a prima facie case mean I am guilty?
No. A prima facie case only means the prosecution has produced enough evidence on each element that, if nothing answers it, a conviction could follow. It is a threshold, not a verdict. The defence is then called, and the court must still be sure of guilt beyond reasonable doubt before it convicts.
When is a prima facie case decided?
Usually at the end of the prosecution's evidence. The court checks whether the prosecution has proved each element of the offence. If it has, the accused is called to enter a defence. If it has not, the accused can be acquitted at that stage without having to give evidence.
What should I do if a prima facie case is found?
Being called to enter a defence is a serious moment that shapes the rest of the trial. Decisions about whether and how to give evidence have real consequences. Do not face this stage alone: proper legal advice before and during it helps protect your position.
