What Does Source of Funds Mean?
Source of funds means where the money in an account came from. It is the story behind the balance: a salary, business takings, a loan, a sale, a gift or savings built over time.
When an account is frozen, this story matters. A lawful, documented source helps explain the money, which is why the phrase comes up whenever an account is under investigation.
Why Does It Matter When an Account Is Frozen?
A freeze rests on a suspicion that money is connected to unlawful activity. Under AMLA 2001 section 50(1), the Public Prosecutor may order a financial institution not to deal with an account suspected of holding proceeds of unlawful activity. [f1]
Showing where your money came from speaks directly to that suspicion. It will not lift the freeze on its own, but it supports your position and helps your lawyer answer the concern behind it.
Which Documents Help?
Useful records include payslips, an employment letter, business invoices, sale agreements, loan papers and bank statements that trace a payment from a known source.
The CCID at Bukit Aman investigates mule-account cases, so a clear, documented explanation can help when you are asked to explain your money. [f3] Our evidence preparation guide shows how to organise these papers.
Can Money Be Released During a Freeze?
You do not have to just wait. Under AMLA 2001 section 44A, you can apply in writing to the enforcement agency that froze the account, asking to release money for reasonable living or business costs. [f2] It is a formal process and depends on your facts.
Possessing or controlling someone else’s account is an offence under Penal Code section 424A. It carries a fine of RM5,000 to RM50,000, or 6 months to 5 years in jail, or both. [f4]
A lawyer can arrange your documents and prepare the written application. Getting legal help early gives you time to gather them.

Why does source of funds matter when my account is frozen?
A freeze rests on a suspicion that the money is linked to unlawful activity. If you can show a lawful source, such as salary, business income or a loan, you answer that suspicion directly. It does not lift the freeze by itself, but it backs up your lawyer's work.
What documents show source of funds?
Payslips, an employment letter, business invoices or receipts, sale agreements, loan papers and bank statements. Statements that trace a payment back to a known lawful source also help. Collect them early and keep them in order, so a lawyer can use them quickly.
Can I get some money released while my account is frozen?
Sometimes. Under AMLA s44A you can apply in writing to the enforcement agency that froze the account, asking to release money for reasonable living or business costs. A more senior officer decides. It is not automatic, and a lawyer can help you prepare the application.
