Why hawker accounts get frozen

Running a food stall means handling cash every day. You bank your takings daily or a few times a week, and the amounts change with how busy the day was.

To you, this is normal business. To the bank’s monitoring system, it can look different.

Banks must report unusual cash deposit patterns as suspicious transactions. [f1] A personal savings account that receives frequent cash deposits in changing amounts can be flagged as suspicious.

Cash transactions of RM25,000 or more must always be reported. [f2] Smaller amounts can still be flagged if the pattern looks irregular.

The bank may not look into your business before it reports. It flags the account, files a Suspicious Transaction Report with Bank Negara Malaysia (BNM), and the authorities may then issue a freeze order.

How the freeze affects your business

Once a freeze under AMLA section 44 takes effect, you lose access to everything in the account. [f3] No ATM withdrawals, online transfers or bill payments, and nowhere to bank your daily takings.

For a hawker, this bites at once. You need cash for fresh ingredients from the morning market, and to pay stall rent, gas and helpers. Without your savings, the stall may stop within days.

The freeze is not a criminal charge. It holds the money while the authorities check where it came from. Your money stays in the account, and the right documents are what you need to ask for it.

Building your source-of-funds evidence

Even without proper bookkeeping, you may have more evidence than you expect. Start with your official documents. [f4] Your hawker licence from the local council shows you run a lawful food business, and your stall rental agreement shows where you trade and what it costs.

Supplier invoices matter too. Receipts from a regular wholesaler show spending that fits a working food stall. Photos of your stall, menu board and customers are also proof the business is real.

Daily sales records, even handwritten in a notebook, show your cash deposits match your real business. Our source-of-funds guide explains how to put these papers into a clear evidence pack for investigators.

Asking for money to be released

While the investigation goes on, you can ask for part of the frozen money to be released. [f5] Under AMLA section 44A, you apply in writing to the enforcement agency that froze the account, and a more senior officer decides. No court is involved.

A lawyer prepares the application, listing your monthly needs: stall rent, ingredients, utilities and family costs. The officer weighs whether releasing money would harm the investigation, so clear proof that your business is real helps.

Having your documents in order before you apply speeds things up. Read more about your rights as an account holder.

What to do right now

Collect your business documents. Your hawker licence, stall rental agreement, supplier invoices and any written sales records. Photograph everything and keep digital copies.

Check your bank access. If you can still log in to online banking, download your transaction history for the past 12 months. Note which deposits match which trading days.

Start a daily sales record today. Even if you kept no records before, starting now shows good faith. Write down each day’s takings, what you bought for stock and what you deposited.

Talk to a lawyer before your police statement. Legal help lets you describe your business accurately. Your first steps after finding the freeze matter.

Stay calm. A freeze is not a charge, and gathering your papers is something you can start today.

Why did the bank freeze my account for depositing my own money?

Banks watch every account for unusual patterns. Daily cash deposits in changing amounts can look like money laundering. The bank may not check whether you run a stall before it reports the account, and the authorities may then freeze it.

I do not have receipts for every sale. Can I still prove my income?

Yes. Your hawker licence, stall rental agreement, supplier invoices and photos of your stall all help. Even a notebook of daily sales figures can support your case. A lawyer can help you put together what you have.

How long will the freeze last?

A freeze by an enforcement agency under AMLA section 44 lasts up to 90 days unless you are charged. [f3] Having your source-of-funds papers ready early, and applying for part of the money to be released, is how you can ask for some access back.

Can I still run my stall if my account is frozen?

Yes, if you have cash in hand. The freeze affects the bank account, not your business licence. Do not put your takings into someone else's account to get round the freeze, because that can make your position worse. Keep a written daily record of your sales instead.

Do I need a lawyer or can I handle this myself?

You can write your own papers, but a lawyer can prepare the application to release money and present your source-of-funds evidence. If cost is a worry, ask the Legal Aid Department about legal aid.
