Partner's Actions Froze Your Joint Account

Why does a joint account freeze when only one partner is involved?

A freeze or a bank hold can cover the whole account, not one signatory. Once a transaction on it is flagged, the whole account can be frozen under AMLA if it is suspected of holding crime money, however many people can use it. [f1]

So you can have had no part in it and still find the account frozen, your business income stuck and your name in the case.

What you knew and what you did set your position apart from your partner’s.

Ask the bank whether this is its own internal review or a freeze ordered by an enforcement agency. Under the 2024 amendments, a police officer of Sergeant rank or above can freeze an account at once under Section 116D, without a court order. [f2]

The answer tells you which authority to deal with and which papers matter most now.

How do you separate your position from your partner’s?

Write down your actual role in the business and the account. Note who usually made transfers, who had online banking access, and what you understood the questioned transactions to be.

If you did not carry out the disputed transactions, bank records, login logs and internal messages can show it. The aim is not to blame your partner. It is to make the facts about your own conduct clear and provable.

How do you keep payroll and suppliers paid?

List what the business must pay soon: salaries, rent, supplier invoices and loan repayments. Under Section 44A, if an enforcement agency froze the account under Section 44, you can apply in writing to that agency to have money released for these reasonable business costs while the case is checked. [f3]

For an AMLA s44 freeze, that is a written application to the agency that issued it, and a more senior officer decides. For a police freeze under Section 116D, the application goes to the Sessions Court.

Do not move business money through a personal account or another company account to get around the freeze. It can cloud a position that is otherwise clean.

Do you need your own lawyer?

Business partners can face very different risks once an investigation starts. If your partner’s conduct is being examined and yours is not, sharing one lawyer can create a conflict of interest that hurts you.

With your own lawyer, your account, your evidence and your interests are put forward on their own terms.

How long can this take?

An AMLA section 44 freeze by an enforcement agency lasts up to 90 days unless someone is charged. Under Section 52A, a later seizure order lapses after 18 months if no one is charged. [f4] That is the legal cut-off, not a target.

A co-signatory with clear records of their own role may find it easier to ask the agency to vary the order.

Who investigates and what do they look at?

A criminal case can go to CCID, the police Commercial Crime Investigation Department. [f5] Investigators may look at who controlled the account, who approved each transaction and what each signatory knew.

Give them your own records early, and speak only for yourself, not for your partner. That helps them assess your part.

How can a lawyer help?

A lawyer can go through the account history, help you set out your role, and apply to vary the order so money can be released for payroll and suppliers. They can also tell you whether you and your partner should have separate lawyers.

Protecting the business does not mean defending every decision your partner made. Your case rests on your own conduct and your own facts.

My partner did something I knew nothing about. Why is our whole account frozen?

A freeze applies to the account, not to one signatory. Once any transaction on it is linked to suspected crime, the whole account can be blocked while it is checked. [f1] Not being involved does not stop the freeze, but it is the core of your own defence.

Can I be held responsible for something I did not know about or authorise?

Criminal liability generally turns on what you personally knew and did. Having your name on the account is not enough on its own. If you truly had no part in the transactions, that is what separates you from your partner.

Can we access money for payroll and suppliers while this is under review?

If the freeze is an AMLA order, you can apply to vary it so money is released for reasonable business costs such as payroll, rent and suppliers. [f3] For an AMLA s44 freeze, the written application goes to the agency that issued it, and a more senior officer decides. A lawyer can prepare it with your company's records.

Should I get my own lawyer, separate from my partner?

Yes, you should consider it. Once one signatory is under investigation and the other is not, your interests may no longer match. Your own lawyer can speak for you without a conflict of interest.

How long will this take to resolve?

An AMLA section 44 freeze lasts up to 90 days unless someone is charged. A later seizure order lapses after 18 months if no one is charged. [f4] Clear records of your own role help the authorities assess your position.

Who actually investigates a case like this?

If it becomes a criminal case, it can go to CCID, the police Commercial Crime Investigation Department. [f5] Giving them your own records early helps them assess your part.
